According to worldwide spread of Free Trade Agreement(FTA), the agricultural and stockbreeding industry in Korea, certainly the most affected field, is faced with so many difficulties. Appreciating the expected adverse effect on the field, Korean government has begun to deal with issues for reforming as well as supporting domestic industry of agriculture and stockbreeding. In order to cope with various difficulties stemming from open-door policies such as promoting conclusion of FTA with other countries, the primary task in the agricultural and stockbreeding industry is to bring its legal regime into compliance with international norms.
This study suggests that the task of amending legal system concerning agricultural and stockbreeding industry should be performed to not only restructure domestic industry of agriculture and stockbreeding but also strengthen international competitive power of it, which are allegedly two main goals for establishing an effective step against market-opening pressure. To reach those policy goals effectively, the legal system of agricultural and stockbreeding industry should be reformed as follows:
First, it is urgently needed to convert the existing domestic agricultural and stockbreeding structure into more market and consumer oriented one.
Secondly, the future legal regime of agricultural and stockbreeding industry should take so-called non-trade concems(NTC) into more consideration.
Thirdly, the related legal regime should be reformed to support environmentally friendly and sustainable industry of agriculture and stockbreeding more effectively.
Fourthly, existing imports and exports regimes and procedures of agricultural and stock farm products, particularly tariff and TRQ systems, should be reformed in accordance with international standard.
Fifthly, we should improve laws regarding trade conflicts to provide against expected agricultural disputes with other countries.
Lastly, in my opinion, Korean Trade Promotion Act should be made as soon as possible for procedural transparency and justice.
