세계 경제의 침체로 신보호주의 무역이 대두되는 가운데 EU는 환경 규
제 장벽을 통해 수입 제한적 조치를 취하고 있으며, 그 제도적 장치중에 하
나로 화학물질등록제도 (Registration, Evaluation and Authorization
of Chemicals; REACH)를 활용하고 있다.
향후 한-EU FTA 체결은 對EU 수출과 국내투자 유치 효과가 예상되나,
우리 수출기업에 피해를 줄 수 있는 REACH제도의 환경규제 등 장벽에 대
해 기업과 정부는 적극적이고 구체적인 대처방안을 마련해야 할 것이다.
REACH제도하에서 EU 역내에 수출하는 화학물질 및 완제품에 대해 제
조업체 및 수입업체는 화학물질의 양이나 그 위해성 정도에 따라 등록
(Registration), 평가(Evaluation), 허가(Authorization), 제한(Restriction)
등에 대한 의무를 준수하여야 하며, 이를 위반 시 행정처분 및 형사처벌을
받게 된다. 하지만 REACH 제도 관련 전문지식 부재, 국내 서비스 업체의 역량 미달, 우수실험기관(Good Laboratory Practice; GLP) 및 실험가
능 항목 수, 기업간의 정보교류 가능한 네트워크 시스템 미비, 전문성 있는
유일대리인의 미확보 등 많은 문제점들이 나타나고 있다. 특히 EU 수출품
중 5,914개의 물질에 대해 국내 기업은 실험평가를 해야 하지만 국내 11
개의 GLP 기관에서 이를 모두 충족시키기는 어렵기 때문에 구조활성예측
모형(Quantitative Structure-Activity Relationship; QSAR)과 같은 비
실험적 대안이 필요하다. QSAR을 이용할 경우 GLP 기관에서 실험에 의
해 발생하는 비용의 64%를 절감하는 효과가 있지만 이 또한 관련 인프라
가 구축되어 있지 못하고 있는 실정이다.
한국의 제2위 수출시장이며(국내 총수출액의 18%를 차지) 무역 흑자가
큰 EU와의 FTA 체결을 앞둔 시점에서 정부는 REACH 관련 인프라 구축
에 더 많은 투자가 필요하며 수출기업 역시 적극적 대응이 필요하다.While new protectionism is risen by stagnation in the world economy, EU
is using environmental regulation and policy for import control, and is utilizing
new chemical registration system, REACH (Registration, Evaluation and
Authorization of Chemicals) as one of the control devices. Hereafter, Korea-
EU FTA will result in the increase of industrial and chemical products for
export to EU and will contribute to attracting more EU's investment into
Korea, but industry and government will have to ready to overcome the
environmental regulatory barrier such as REACH system that can potentially
deal damage in Korean export industry.
REACH requires every manufacturer and importer who imports or
manufacturers more than 1 metric ton per year of substance of intended to
be released must register that substance with the European Chemicals Agency
(ECHA) for Evaluation and Authorization. And failure to register means that
the substance will not be allowed to be manufactured or imported in the
EU. However, there are many problems in Korea such as a small number
of consulting service companies, few GLP(Good Laboratory Practice) laboratories and small number of endpoints they can deal with, and lack of
information network system for data sharing between manufacturer and
downstream users. Especially, Korean export companies to EU are required
to do experimental estimation for endpoints relevant for REACH regulation
about 5,914 substances included in export products, but because it is impossible
to collect all the endpoint data from domestic GLP laboratories, it also
needs the alternative way such as non-testing QSAR (Quantitative Structure-
Activity Relationships) method, which gives an effect of 64% reducing of
GLP testing expenses, as an infrastucture for REACH
In conclusion government and export companies need more investments
in infrastructure to solve these problems caused by the REACH regulation
at this point in time of finalizing Korea-EU, Korea's second largest export
market, FTA negotiation.
