In this paper, I attempted to criticize what is called "the Peaceful Demonstration Zone Policy"("PDZP") proposed by the National Police Agency as soon as Lee Myong Bak was elected as president. Peaceful Demonstration Zone is a zone intended to promote peaceful demonstration by guaranteeing assembly organizers and participants less police regulation within that zone and/or providing other incentives like parking lot and toilet for assembly participants while outside the zone the routinized police regulation such as police bus barricade is applied. In analysing PDZP, I started to tie it up with the overall legal regime in this field the thrust of which is the Act on Assembly and Demonstration because if the legal regime governed by the Act is very harsh, the privilege of PDZP is nothing but a means to support such harsh legal system, though the benefit of PDZP itself is not harsh. And then, I moved to prove the harsh character of the Act. In so doing, I delved into the 'relational' nature of the Freedom of Assembly and Demonstration("FAD"). as opposed to 'atomised' nature of other liberties like personal freedom. The relational nature means one that something?like FAD is by nature guaranteed to involve other people and have an impact on their opinions so that it should not be restricted by law only because any assembly and demonstration may cause inconvenience to general public whatsoever. I believe that the Act on Assembly and Demonstration in Korea has various legal devices to excessively restrict FAD such as prohibition of outdoor assembly after sunset. The second justification for challenging the constitutionality of the Act lies in the 'preferred position' of the freedom of political assembly compared to other assembly because without political assembly, the democratic formation of the state is unthinkable. I concluded that PDZP may be compatible with the constitution only under the condition that general legal regime governing Assembly and Demonstration guarantees FAD in a proper way within constitutional boundary.
