본 연구는 인터넷 기반의 미디어 네트워크 접근 규제가 콘텐츠 다양성
과 같은 사회문화적 이용자후생을 담보할 수 있는 수단으로 기능해
야 한다는 관점에서, 현행 IPTV 네트워크 동등제공 규제의 적정성을 분석하
고 정책적 대안을 검토하였다. 분석 결과, 다음과 같은 두 가지 형태로 네트
워크 동등제공 규제의 필수성 요건을 확대·변용할 필요가 제기되었다. 첫
째, 네트워크를 보유하지 못한 사업자의 시장 진입이 산업·경제적 차원에서
유의미한 성과를 증진시킬 가능성이 낮더라도 해당 사업자가 콘텐츠 다양성
을 증진할 수 있는 콘텐츠 제작 및 유통 능력을 가졌다면 네트워크 동등제공
의 필수성을 폭넓게 적용할 필요가 있다. 둘째, 네트워크 동등제공 규제의
필수성 적용 대상을 콘텐츠 사업자로 전환하여, IPTV와 같은 신규미디어
출구를 통해 다양하고 공익적인 콘텐츠가 시장에 적극 유입될 수 있도록 할
수 있다. 이때 구체적 적용 방안으로는 시장구조 분석과 대상적 접근을 채택하여, IPTV 사업자의 사적재산권 보호와 자유로운 콘텐츠 유통이라는 양립
적 가치를 절충하는 것이 바람직하다.This study aims to suggest policy alternatives by critically examining
whether the IPTV Network Equal Access Rule enables to increase
the non-economic welfare of media users, especially content diversity.
The following results should be highlighted in order to properly set
the Essentiality of the Equal Access Rule of IPTV network;
First, it is desirable to allow IPTV service providers without network,
which seem not to be able to increase the economic efficiency, enter
the market through the Equal Access Rule of IPTV network if it has
the ability to create and distribute the content with good quality.
Second, the Equal Access Rule of IPTV network needs to be applied
to content service providers in order to promote the entry of diverse
contents. Market structure analysis and quid pro qui-based access
make it possible to maintain the balance between the economic incentive
of IPTV network owners and content service providers’ free
access to network.
