본 연구는 미국 토지이용계획과 규제의 역사적 고찰을 통해 19세기부터 시작된 본격적인 공공개입을 통한 근대적 토지이용계획과 규제들의 발전과정과 현재까지의 주요 흐름을 살펴보고, 미국 토지이용규제의 구성 및 계획체계와 이와 관련된 주요 법적 쟁점들을 분석해 보고자 한다. 이를 통해 나타난 미국 토지이용계획 및 규제 관련 법제의 체계와 주요 법적 쟁점들의 특성을 요약해 보면 다음과 같다. 첫째, 미국 토지이용규제는 산업혁명 이후에 나타난 도시문제를 해결하기 위해 위생문제 해결을 위한 시도로서 시작되어, 도시미화운동으로 대표되는 근대 도시계획 분야의 탄생과 1916년 뉴욕시가 처음으로 채택한 조닝과 함께 본격적으로 발전되었다. 이 후 다양한 조닝기법들이 도입되고 70년대부터 본격적으로 추진된 스마트성장정책과 최근의 뉴어버니즘에 의한 기법. 기후변화에 대응하기 위한 토지이용규제 기법 등이 꾸준히 시도되면서 다양한 토지이용규제의 수법과 제도들이 발전되어 왔다. 둘째, 미국 토지이용계획과 규제는 수권법에 의해 위임된 권한에 따라 각 지방정부중심으로 체계를 갖추고 있다. 셋째, 미국 토지이용규제의 핵심은 용도지역제를 중심으로 한 조닝이며 분할규제가 조닝을 보완하며 활용되고 있다. 또한, 근대 토지이용규제가 시작되기 이전부터 토지이용을 제한하던 보통법상의 토지사법들, 즉 생활방해와 토지예속권 등이 현재에도 토지공법의 빈틈을 보완하며 중요한 역할을 하고 있다. 넷째, 토지이용계획과 규제에 관련하여 가장 중요하게 대두되고 있는 법적 쟁점으로는 해당 토지이용규제를 제정하고 시행하는 정부의 권한문제(ultra vires), 미국 연방수정헌법 제5조에 의한 ‘적법절차(due process)’와 ‘규제적수용(regulatory taking)’ 문제, 수정헌법 제1조에 의한 표현 및 종교의 자유문제, 수정헌법 제14조에 의한 평등권 문제로 요약될 수 있다.This article explores the legal system for land use planning and control in the United States. To do so, it begins with the historical development of the U.S.'s land use planning and control. And then, it examines the legal structure and system for land use planning and control, and analyzes the major legal issues regarding land use law. The findings of this study are as follows. First, the legal system for land use planning in U.S. began to cope with the serious sanitary problems for housing due to the rapid industrialization in the late 19C and has been evolved through developing the various zoning techniques and dealing with environmental issues. Second, local governments are delegated to adopt and implement land use system by enabling laws. Third, zoning is the core tool to regulate land use, which is supplemented with subdivision law. In addition, private land use laws, such as nuisance and servitude including easement and covenant, still play an important role in regulating land use matters. Fourth, the major legal issues center around ultra vires, due process and regulatory taking under the Fifth Amendment, the Free Speech clause under the First Amendment, and the Equal Protection clause under the Fourteenth Amendment.
