모든 사람은 주거 안정성을 가지고 강제퇴거, 괴롭힘, 기타 위협으로부터 법적 보호를 보장받아야만 한다. 이에 따라 우리나라에서 시행되는 재개발사업에 서의 강제퇴거로 인한 문제에 대해서도 관련 법률들의 정비와 개선이 시급한 과제로 대두된다. 이와 관련하여 필자는 생업을 영위하던 거주민들이 생계활동을 지속할 수 있도록, 퇴거 이전에 충분한 보상을 받게 하는 것에 중점을 두고 논의를 하였다. 특히 현실적으로 영업손실 보상에 있어서 가장 첨예하게 대립하고 있는 문제는 상가임차인의 권리금을 인정할 것인가이다. 거래 현실에서는 권리금이라는 명목으로 적지 않은 금액이 수수되고 있다. 하지만 정면으로 이를 다루거나 보호하는 법 규정은 없다. 이처럼 권리금이 반영되지 않는 비현실적인 보상은 또 다른 용산참사를 불러올 수 있는 소지를 안고 있다. 때문에 필자는 권리금을 포함한 영업손실 보상의 근거를 마련하기 위해 관련법들을 검토해 보았다. 그리고 그 주된 목적은 음성적인 권리금을 법적으로 제도화하여 상가임차인에 대한 현실적인 보상을 재개발사업에서의 퇴거요건으로서 마련하고, 이를 통해 개발의 미명하에 인권이 유린되는 것을 방지하는 데에 두었다.
하지만, 본 논문이 권리금이라는 재산권의 보상에 대한 조명에만 그치고 있는 점은 한계이다. 즉, 보상에만 국한된 논의는 자칫 보다 더 중요한 주거인권의 논의의 본질을 희석시키는 면으로도 작용할 수 있다는 우려가 있다. 때문에 보상 문제를 다룸에 있어서도 그것이 주거인권을 확장시키는 하나의 축으로 작동할 수 있도록 해야 한다는 점을 염두에 두어야만 할 것이다.It goes without saying that the right of residence should be guaranteed for everyone to be protected from deportation, bullying and/or other threats. Residents will suffer legal disadvantages especially when they are subject to deportation caused by redevelopment projects. That is why relevant laws, acts and other legal devices should be improved to guard the powerless and underprivileged. Specifically, this study focuses on legal procedures by which those residents renting shops or stores can be compensated for deportation so that they can gain subsistence. In regard to business indemnification, one important question is raised on whether premium should be regarded as a legal right for commercial tenants. Even though substantial amounts of money are charged and offered in the name of premium in the real world of transaction, there have been no regulations for compensations that cover this explicitly. Unrealistic indemnification that does not reflect premium is likely to bring about another Yong-san tragedy. For this reason, this study reviewed relevant laws and acts to investigate legal bases for indemnification including premium.
It is regrettable that this study is limited to premium as compensation for property rights, because the bigger picture of the right of residence could be diluted or overlooked.
