우리 공직선거법은 제93조에서 “탈법방법에 의한 문서·도화의 배부·게시 등 금지”라는 표제하에 제1항에서 “누구든지 선거일전 180일(보궐선거 등에 있어서는 그 선거의 실시사유가 확정된 때)부터 선거일까지 선거에 영향을 미치게 하기 위하여 이 법의 규정에 의하지 아니하고는 정당(창당준비위원회와 정당의 정강·정책을 포함한다. 이하 이 조에서 같다) 또는 후보자(후보자가 되고자 하는 자를 포함한다. 이하 이 조에서 같다)를 지지·추천하거나 반대하는 내용이 포함되어 있거나 정당의 명칭 또는 후보자의 성명을 나타내는 광고, 인사장, 벽보, 사진, 문서·도화, 인쇄물이나 녹음·녹화테이프 그 밖에 이와 유사한 것을 배부·첩부·살포·상영 또는 게시할 수 없다.”라고 규정하고 있다.
우리 헌법재판소는 위 규정에 대하여 “선거운동 기회균등 보장의 원칙에 입각하여 선거운동의 부당한 경쟁 및 후보자들 간의 경제력 차이에 따른 불균형이라는 폐해를 막고, 선거의 평온과 공정을 해하는 결과의 발생을 방지하기 위하여 필요한 것이고, 또한 이러한 제한은 표현행위에 대한 내용근거규제가 아니고, 내용중립적인 규제이기 때문에, 즉 필요최소한의 제한수단이기 때문에 합헌”이라고 판시하고 있다.
그러나 공직선거법 제93조 제1항은 선거쟁점과 관련되기만 하면 일체의 표현을 하지 못하도록 막고 있다는 점에서 내용근거규제에 해당하고, 따라서 이러한 입법의 위헌심사에는 엄격한 심사기준이 적용되어야 한다. 위와 같은 규정이 선거의 자유와 공정을 위하여 반드시 필요한 것이라는 점을 정부가 입증하여야 할 것이다. 일정한 선거비용의 제한을 두고, 그 범위 내에서는 후보자나 일반 국민 모두 어떠한 형태의 문서를 선택할지는 그들의 자유에 맡기는 것이 오히려 선거의 공정을 더욱 확보할 수 있는 방안이다.
무엇보다도 정치적으로 성숙한 우리 국민을 후보자들의 부당한 과열선거경쟁의 수동적 당사자로만 보고 있는 위 법규정 및 헌법재판소 결정은 조속히 시정되어야 할 것이다.Our “Public Official Election Act” Article 93, under the title “Prohibition of Unlawful Distribution of Posting, etc. of Documents and Pictures”, Section (1) provides “No one shall distribute, post, scatter, play, or run an advertisement, letter of greeting, poster, photograph, document, drawing, printed matter, recording tape, video tape, or the like which contains the contents supporting, recommending or opposing a political party (including the preparatory committee for formation of a political party, and the platform and policy of a political party) or candidate (including a person who intends to be a candidate) or showing the name of the political party or candidate with the intention of influencing the election, not in accordance with the provisions of this Act, from 180 days before the election day (the time when the reason for holding the election becomes final, in case of a special election) to the election day”.
And Our Constitutional Court held that above-said provision is constitutional because of the following reasons; The purpose of Article 93 Section 1 of POEA is to increase the freedom and fairness of elections by deterring unfair competition in electioneering or unbalance among candidates caused by a difference of financial capacity and preventing an outcome harming the tranquility and fairness of the election. And the restriction caused by the Instant Provision can be considered as the least restrictive means for the abovementioned purpose. Furthermore, The Instant Regulation is not content-based regulations, but content-neutral regulations"
But Article 93 Section 1 of POEA is not content-neutral regulations, but content-based regulations. Election Campaign through written or graphic materials should be guaranteed as a freedom of political expression. Accordingly, prohibiting this is restricting the freedom of electioneering without justifiable reason, so it is contradictory to the Constitution.
