최근 무형문화유산 또는 전통문화표현물의 이용사례가 증가하고 잠재적 가치가 조명받으면서 관련 분쟁사례도 증가하고 있다. 무형문화유산의 보유자들이 가진 이해관계는 저작권법을 통해 일부 반영할 수도 있지만, 현행 저작권법 체계는 무형문화유산을 충분히 보호하는데 한계가 있다. 우리 저작권법의 해석상 무형문화유산을 기반으로 한 2차적저작물과 편집저작물, 실연자의 저작인접권 등은 보호를 받을 수 있겠지만, 무형문화유산 그 자체는 보호를 받기가 어렵다.
자국의 저작권법에 전통문화표현물에 관한 규정을 두고 있는 국가들의 관련 법조항을 비교, 분석해 보면, 보호의 대상인 전통문화표현물을 정의하고 보호요건을 정함에 있어서 각국의 입법례는 다양한 입장을 보이고 있지만, 권리의 귀속주체를 대부분 국가기관 또는 그로부터 위임을 받은 기관이 하는 것으로 규정하고 있다는 점에서는 공통점도 엿보인다. 또한 보호의 범위와 관련하여 각국은 대체로 저작인격권 및 저작재산권에 유사한 권리를 부여하고 있는 것으로 조사되었다. 하지만, 현재 WIPO 정부간위원회(IGC)에서 논의되고 있는 초안의 관점에서 볼 때 각국의 입법례들은 몇 가지 점에서 한계가 있었다.
외국의 입법사례와 WIPO IGC의 논의에 맞추어 우리나라도 전통문화표현물의 보호에 관한 정책적 판단을 할 시점이다. 정책적 판단을 위해서는 유관기관을 중심으로 국내 전통문화표현물의 현황과 이해관계에 관한 실증적 조사가 선행되어야 하며, 그 결과를 바탕으로 법적 보호가 필요한 전통문화표현물의 종류와 그 특징들을 추출한 후, 보호의 대상과 요건을 규정하고, 권리의 귀속 및 행사 주체, 권리의 내용과 예외, 위반시의 제재조치 등에 관한 사항을 규정할 필요가 있다.With the frequent use of intangible cultural heritage and the spotlights on its potential value, disputes are increasing. Whereas copyright may reflect interests of intangible cultural heritage holders, the current copyright system is limited in providing the enough protection of intangible cultural heritage. In other words, copyright protects derivative work, compilation works and performers's right based on intangible cultural heritage, but it often fails to protect intangible cultural heritage itself.
This study compares and analyses relevant regulations of foreign countries which have legislations on traditional cultural expressions in their domestic copyright law. Each country has several things in common; they appoint national authorities or competent authorities as an owner or beneficiaries of rights in defining traditional cultural heritage and its protection boundaries. In addition, each country entitles moral right and copyright relating to the scope of protection. However, regulations of each country have a few limitations from the point of view of the draft discussed in WIPO IGC.
It is time for our country to make a policy on the protection of traditional cultural expressions, referring to cases overseas and WIPO IGC discussion. This policy making process should involve an empirical study about the domestic traditional cultural expressions. The study will help extract the kinds and features of traditional cultural expressions which need legal protection, define subject matter of protection and criteria for eligibility and further provide(regulate) an owner or beneficiaries, scope of protection and exceptions, sanctions and remedies.
