종래 저작물의 파괴와 관련해서는 변경과 달리 동일성유지권이 미치는 것은 아니며, 그것은 당해 원작품을 가지고 있는 소유자의 자유에 맡겨진 문제로 보았다. 그러나 본고에서는 특정분야의 저작물, 즉 저작자의 사상과 감정이 유체물 위에 혹은 유체물 속에 형상, 모양, 색채 등으로 표현되는 저작물은 그것이 최초로 고정된 유체물이 파괴되면 저작물의 동일성이 침해되는 것이라는 이론적 전제하에 당해 유체물에 관한 소유권과의 조화를 모색해야 한다고 보았다. 그런 의미에서 미술저작물의 원작품의 파괴를 오로지 소유자의 손에 맡기는 것은 이론적 측면에서도 올바른 것이 아니다. 결국 소유권과 저작권의 조화가 필요하고, 소유자의 이익과 저작자의 이익의 균형이 유지되어야 한다. 그러므로 특별한 규정이 없는 현행법 하에서는 양측의 이해관계를 고려하여 권리행사의 당부를 사례별로 판단할 수밖에 없다. 그러나 분쟁이 일어났을 때 모든 문제의 해결을 사례별로 하도록 법원에 일임하는 것은 특히 법적안정성 측면에서 그리 현명한 법정책인 것 같지는 않다. 저작자에게 권리행사를 보다 원활하게 할 수 있도록 하기 위해서도, 그리고 소유자에게 저작물 파괴시 일정한 행동 지침을 주어, 만일에 있을지 모르는 분쟁을 사전에 예방하기 위해서도 지금까지의 분쟁사례나 제 외국의 입법례를 참작하여 일정한 기준을 법제정이나 개정을 통해 제시하는 것이 옳다고 본다. 그 경우 스위스 입법례가 좋은 참고가 된다는 것이 많은 학자들의 지적이다. 본고에서는 스위스 법을 그대로 계수할지 아니면 스위스 법보다 좀 더 제한을 가할지는 더 연구되어야 할 과제라고 보았다.Korean legislator gives the author the right to preserve the integrity of the content, form, and title of his work(Copyright Act, Article 13). Could this right be extended to the owner's destruction of the physical object of the work? Most scholars argue that if the work has disappeared from sight, the author's reputation can not be damaged by something that the public can not perceive. But I think that destruction is the ultimate form of mutilation. So I say YES concerning the certain works, for example artistic works, which have to be expressed in the tangible medium from the first, because the destruction of the physical object of the artistic work means that the artistic work itself exists no longer. So the preservation of that work is violated. The copy is not the same content and form as the original. In that work, the destruction is indeed the most extreme form of mutilation. So the copyright act does not mention the destruction expressly, and the destruction of the artistic original work violates the integrity right of author. Then could the author prohibit the destruction of the physical object of the work at any time? I say NO. If yes, it means the destruction of the basic system of the property law. Both rights are the same. Neither the property right nor the copyright is superior or inferior to the other. Both rights are granted and protected by the Constitutional Law. So the conflict between the owner's property right and author's moral right will arise. There need be a compromise and a balance between the interest of the owner and that of the author. At present we have to solve the problem by considering the circumstances of each case when the conflict arises. But it's not wise. We need the express solution. The article 15 of the Swiss Copyright Act is a good example. But to legislate, we need a further study and research. To adopt the Swiss model as is, or add some modification depends on the further study.
