결사의 자유란 “다수의 자연인 또는 법인이 그 자유의사에 따라 공동의 목적을 위하여 단체를 결성할 자유”로 곧잘 정의된다. 우리 헌법은 제21조 제1항에서 “모든 국민은 언론․출판의 자유와 집회․결사의 자유를 가진다.”고 규정하여 언론의 자유, 출판의 자유, 집회의 자유와 함께 결사의 자유를 헌법상의 표현의 자유의 하나로 명시하고 있다. 미국 연방대법원도 수정헌법 제1조의 표현의 자유 조항과 수정헌법 제5조와 제14조상의 적법절차조항으로부터 ‘결사의 자유’(Freedom of Association)를 끌어낸다. 미국에서는 결사의 자유가 불법단체에 회원으로 가입하고 있는 개인의 처벌 문제, 회원명부의 공개문제, 공무원 임용요건으로서의 충성선서의 문제, 국회의 국정조사 시 단체정보의 공개범위의 문제, 단체가 당사자가 되는 소송의 문제 등을 중심으로 그 법리가 발달해오고 있다. 결사의 자유에 대해서 미국 연방대법원의 주요 판결들에 대한 분석을 중심으로 그 법리를 살펴보는 것이 본 연구의 목적이다. 이를 위해 결사의 자유의 미국 헌법상의 근거에 대해 살펴보고, 결사의 자유에 관한 미국 연방대법원의 주요 판결들을 시기순으로 분석해 본다. 1958년의 NAACP v. Alabama ex rel. Patterson판결, 1961년의 Scales v. United States판결, 1963년의 Gibson v. Florida Legislative Investigation Comm.판결, 1966년의 Elfbrandt v. Russel판결, 1967년의 Keyishian v. Board of Regents판결, 1982년의 NAACP v. Clairborne Hardware Co.판결, 1984년의 Roberts v. United States Jacycees판결을 사실관계, 다수의견과 반대의견의 주된 내용, 그 판결이 가지는 의미 등을 중심으로 자세히 분석한다. 그리고 이러한 판결분석을 근거로 이를 통해 귀납된 결사의 자유의 법리들을 정리해본다.The freedom of association is defined as the freedom to form an organization by the free will of persons. Art.21 Sec.1 of Korean Constitution stipulates the freedom of association as one of freedoms of expression. The U.S. Supreme Court draws the freedom of association out of the freedom of expression clause in the First Amendment and the due process clause in the Fifth and the Fourteenth Amendment. In the States, the crucial issues concerning the freedom of association have been the restraints on membership and association action, the group registration and disclosure requirement, the restraints on government employment and benefits such as the loyalty oaths, the legislative investigation and forced disclosures, and the group litigation. This paper aims at examining the legal principles on the freedom of association by analyzing the concerned major decisions of the U.S. Supreme Court. To achieve the aim, it will examine the constitutional grounds of the freedom of association at first. Then, this paper will analyze in depth the major decisions of the U.S. Supreme Court representing their decades in regards to the freedom of association that include NAACP v. Alabama ex rel. Patterson in 1958, Scales v. United States in 1961, Gibson v. Florida Legislative Investigation Comm. in 1963, Elfbrandt v. Russel in 1966, Keyishian v. Board of Regents in 1967, NAACP v. Clairborne Hardware Co. in 1982, and Roberts v. United States Jacycees in 1984. Finally, it will induce the legal principles on the freedom of association from the analyses.
