3세대 인권 중 하나인 평화권은 추상적 가치인 평화가 침해될 수 없는 권리로서 보장됨을 의미한다. 국제사회에서 평화권의 논의는 1980년대부터 시작되었지만, 아직 실질적인 국제인권규범으로 자리 잡지는 못했다. 평화권은 이처럼 아직 확립된 권리가 아니며 권리로서의 효력 역시 불명확하지만, 한국 사회운동은 2000년대에 들어서면서 이 낯선 권리를 말하기 시작했다. 누가, 왜 평화를 인권이라 주장했을까? 이 질문에 대해 답하기 위해 이 연구는 한국 사회운동의 평화권 담론을 분석하고자 한다. 이는 법률적·제도적 측면에서 치우쳐 있는 인권 연구에서 벗어나, 인권을 아래로부터 접근하는 사회학적 시도이다.
평화권이 한국사회에서 등장했던 과정은 두 흐름으로 나눌 수 있다. 첫째는 국제사회의 북한 인권 압박에 대한 대항담론으로서의 평화권이다. 평화권을 대항담론으로 내세웠던 이들은 미국을 중심으로 한 대북 인권 압박의 이면에 존재하는 폭력성을 예감했고, 그러한 압박이 또 다른 인권인 평화권을 침해한다는 담론을 구성했다. 평화권이란 인권이 저해되는 방식으로 인권 문제를 해결하는 것이 모순이라는 비판이었다. 이 담론은 인권 내부에 다양한 권리가 존재함을 강조했으며, 그 속에서 평화권이 우선적으로 보장되어야 한다는 주장으로 이어졌다.
두 번째 흐름은 반전평화운동의 흐름 속에서 형성된 평화권이다. 이라크 반전운동을 시작으로 평화권에 대한 문제의식을 형성시킨 인권운동가들은 평택 미군기지 확장을 반대하는 담론으로 평화권을 전면에 내세웠다. 이들은 정부가 미국과 맺은 전략적 유연성 합의와 이를 위한 평택 미군기지 확장은 주민들의 생존권과 함께 한국 국민들이 전쟁의 위협에서 벗어나 살 수 있는 평화권을 침해하는 것이라고 비판했다. 이 담론 속에서 구성된 평화권은 폐쇄된 안보 영역에 개입할 수 있는 열쇠가 되었다. 권리로서의 평화에는 안보 영역의 사안을 법과 공론의 장으로 끌어낼 수 있는 가능성이 담겨 있었기 때문이다.
평화권은 새로운 권리를 통해 새로운 저항을 만들어가려는 이들의 노력을 통해서 한국 사회에 등장했다. 이들이 외치는 평화권 담론을 분석하면서 무엇을 박탈당한 이들이, 무엇을 지키기 위해 평화권을 말하는가를 확인할 수 있다. 비록 평화권에 대한 제도적 인정은 쉽지 않을 것이라 예상되며, 평화권과 관련된 사회운동 역시 이전만큼 활발하지 못한 상황이지만 이 역시 기존 질서 속에서 새로운 인권이 형성되는 ‘과정’이라 할 수 있다. 인권은 저항의 언어가 이어지는 곳에서 만들어진다.The right to peace, one of Third-generation human rights, defines peace as inviolable rights. Although discussions on the issue have begun in the international community as early as the 1980s, it has failed to settle its stand on a substantive international human rights norm yet. This unstable and unfamiliar idea, however, has been chosen as a tool of resistance by Korean social movements. Who, and why do they insist peace to be a human right? To answer this question, this paper will review the discourses on the right to peace raised by Korean social movements in the 2000s, taking a sociological approach to the human rights formation process from grassroots up.
There were two major trends in the emergence of the right to peace in Korean society. The first stream appeared as a counter-discourse against the international society putting pressure on North Korea regarding human rights issues. People have penetrated the violence hidden beneath the surface of the pressure manipulated by America and others, and created a counter-discourse that such oppression is being enforced by violating another human rights. They criticized the contradiction lying in that offensive approach, made in the name of ‘human rights protection’, saying it is actually executed at the expense of the right to peace. It was emphasized that human rights were consisted of diverse rights, furthermore the right to peace should come to be a priority.
The second stream was generated through the experience of anti-war peace movements for Iraq. The movement have helped human rights activists develope a critical mind on the right to peace, which led to efforts to compose new discourses against the expansion of the US military base in PyeongTaek. They asserted that the “strategic flexibility” agreement between the US and Korean government and the attendant expansion of the US base severely violated the right of the people to maintain a peaceful life. These discourses have become the key to intervene the untouchable national security sector. That is because when peace is considered as a right, it opens up the possibility to draw the national security issues into the field of law and public debate.
The right to peace could emerge in Korean society by the efforts of those who tried to introduce new human rights and make alternative resistances. Through the work of analyzing these new discourses, this study could reveal who spoke for this right and why. It could be quite challenging to institutionalize the right to peace, and the social movement regarding this issue is not lively at this moment, but still it can be seen as the process of its formation. Human rights have been secured where voice of resistance existed, and so will the right to peace.
