국회에 접수된 법안의 입법시간과 입법결과는 왜 다르게 나타나는가? 그리고 이러한 차이는 어떻게 설명할 수 있는가? 본 논문은 법안 발의자의 특성과 법안 성안과정상의 특성, 법안의 개정규모가 입법시간과 입법결과에 미치는 영향을 실증적으로 살펴본다. 한 법안이 국회에 발의·제출되어 최종적으로 처리되는데 걸리는 시간과 해당 안이 원안가결·수정 가결·대안반영폐기·임기만료폐기·철회·가결 등의 입법결과로 귀결되는데 다양한 변인이 미치는 영향을 제17대 국회 법안 전수 자료를 통해 검증한다. 본 논문의 경쟁위험분석법(competing risks analysis)은 법안이 각각의 사건을 경험할 수 있는 위험(가능성)은 상호 경쟁하고 있으며, 해당 법안의 내적속성은 각 사건의 발생위험에 영향을 주어 이 중 한 가지 사건을 실현시킨다는 전제를 토대로 한 생존분석(survivalanalysis)의 확장형이다. 분석 결과는 입법 결과를 가결과 부결, 혹은 처리와 미처리의 이분법으로 분류한 기존 시각에서 발견할 수 없었던 흥미로운 패턴이 나타났다. 특히, 정부가 제출한 법안은 원안 가결되는 경우보다는, 위원회 혹은 본회의의 수정을 거쳐 가결되는 경향이 높은 반면, 상임위원회 위원장 대표로 발의된 법안은 원안 그대로 본회의를 통과할 가능성이 다른 법안보다 높았다. 이러한 결과는 국회 내부의 정치역학과 행정부와 국회 간 견제의 양태를 살펴보는데 풍부한 함의를 제공한다.This paper aims to examine the determinants of the difference in legislative time and legislative outcomes. What makes bills different regarding the length of their legislative process and results? We hypothesize that the characteristics of bills’proposers, the specifics of enacting process, and revised scale of bills influence how long it does take a bill to become a law and what became a law or not. To test hypotheses related to the political dynamics of legislative process, a competing risks model as an extended form of survival analysis is applied. The results show that bills initiated and sponsored by the Executives tend to get passed in the floor with revision while those by the legislative committees go through the floor as drafted. This shows strong implications on the patterns of the separation of powers and checks and balances between the Executives and the Legislative Branch in Korean politics.
