국민의 건강보호와 증진을 위해 규정된 의료법은 동법의 목적을 달성하기 위하여 의료기관의 개설 당시부터 일정한 제한을 두고 있다. 우선 개설자와 관련하여 비의료인의 의료기관개설을 금지하고 있고, 의료인이라 할 지라도 자격에 따라 개설할 수 있는 의료기관의 종류를 제한하여 규정하고 있다. 또한 영리성추구를 금지하여 영리의료법인을 개설할 수 없도록 하고 있고, 신고제와 허가제를 두고 있다. 그리고 의료인이라도 2개 이상의 의료기관을 개설할 수 없도록 규정함으로써 의료인의 진료충실을 꾀하고 있다. 이러한 제한은 국민보건의 향상에 순기능을 담당하기도 하나, 의료인의 입장에서는 직업적 자유를 과도하게 제한하고, 국민의 입장에서도 다양하고 수준높은 진료를 받을 기회를 축소시킬 수 있는 역기능도 무시할 수가 없다. 그러므로 특히 의료인에 의해 주도되는 의료기관의 개설의 경우 복수의료기관개설을 가능하도록 하는 등 합리적 범주 내에서의 규제완화를 통해 국민보건의 향상을 도모하는 의료법의 개정이 필요하다고 할 것이다.Medical Law puts a certain amount of limitations on the establishment of medical clinics to achieve its purposes to protect and improve the health of the people. First of all, the law bans the establishment of medical clinics by non-medical practitioners and imposes restrictions on the types of medical clinics which can be established by medical practitioners according to their qualification. In addition, the law, based on the registration and license systems, prohibits from seeking profits so as not to establish for-profit medical corporations. Besides, by prescribing regulations that prohibit a single medical practitioner from establishing more than two medical clinics, the law pursues reliable medical treatment by medical practitioners.
With positive effects on improving national health status, these limitations have negative effects as well in that they excessively restrict vocational freedom from the medical practitioner's view, and reduce the people's opportunity to receive various and high-quality medical treatment. Therefore, it needs to revise Medical Law to seek public health advancement by reasonably lifting and easing regulations so that medical practitioners are allowed to establish more than two medical clinics.
