마음의 작용과 뇌 활동의 연결관계를 연구하는 인지신경과학의 발달은 다양한 학문영역에 학제적 연구를 가능하게 하였고, 법적 규칙과 기준에 신경학적 발견의 결과를 고려하기위한 새로운 학제적 연구분야로 신경법학(Neurolaw)을 형성하였다. 인지신경과학의 연구결과를 법적 해석에 적용하고자 하는 신경법학은 기억 연구와 관련 부분에서 그 활용가능성의증대와 중요성이 예측되었고, 이러한 관점에서 국외에서는 이미 참/오기억의 탐지기술,동조와 피암시성과 같은 기억왜곡의 외인적 요인(사회적 변인), 그리고 기억 진술의 의도적기만행위의 탐지기술 등에 관한 몇몇 연구결과들이 발표되기 시작하고 있다. 반면, 신경법학의 연구결과에 대한 법적 증거의 허용성 여부와 관련하여 뇌 기반적 기억연구의 한계가현존한다는 현실적 상황 또한 고려하지 않을 수는 없다. 그럼에도 불구하고 국외에서 보여지는 신경법학 연구지원의 절대적 증가와 그로 인해집적된 연구결과들로 인해, 관련 연구는 점점 더 정확성을 가지게 될 것으로 전망되며,경우에 따라 우리 형사사법절차에도 직접적인 영향을 미치는 시기가 도래할 가능성을 부인할 수 없다. 이러한 상황에서 본 논문은 먼저, mind 연구 영역이라는 관점에서 공통점을지니는 형사법학과 인지신경과학의 관계를 살펴보고, 영국과 미국의 형사절차상 현재 활용되어지고 있는 신경법학적 형사사법 시스템과 재판에서의 증거 허용성 여부에 대해 살펴본다. 다음으로, 기억시스템에 대한 인지신경과학적 이해를 바탕으로 최근 신경법학의 기억연구들을 살펴본 후, 진술증거에 대한 뇌기반적 분석 가능성과 증거 허용성에 대해 생각해본다.The growth of cognitive neuroscience, the scientific study of connection be-tween brain and mind, has allowed interdisciplinary research among various fields of studies, and also established the basis for application of neuroscience in the justice system: Neurolaw. The legal applications of neuroscientific research on memory has become a topic of great interest, and a growing number of literatures on memory and deception detection, suggestibility, and conformity has been re-cently published, internationally. However, the topic should be approached with caution since neuroscientific research on memory cannot yet fully integrate into current justice system. While a caution is needed, it is not to be doubted that high increase in effort for neurolaw and growth of knowledge and literature will develop the validity of the field, and it will also cause changes in our criminal law system in near future. In preparing of the change, we examine the connection between criminal justice system and cognitive neuroscience focusing on “mind” component of human be-haviors, and also emphasize its application and legal validity as currently em-ployed in the United States of America and the United Kingdom. We then also discuss the possibility and legal validity of brain-based analyses based on cogni-tive neuroscientific understanding, after examining recent researches of the field.
