현재는 연구성과의 결과인 지식재산권이 국가의 경쟁력을 좌우하는 기술우위의 사회, 즉 지식의 창출, 확산 등이 국가의 신성장동력이 되고 경제성장을 주도하는 ‘지식기반경제’로 전환이 되고 있다. 이에 글로벌 수준의 지식재산 관련 법제도 시스템을 정비하고 연구자 및 창작자에 대한 보상체계 혁신 등이 중요 사안으로 부각되고 있다. 정부는 이미 2006년 특허법을 개정하여 직무발명에 대한 보상체계와 내용을 발명진흥법에 통일적으로 규율하는 등의 개선을 하였다. 발명진흥법은 발명을 하도록 연구개발투자와 시설 등을 제공한 사용자와 창조적인 노력을 제공하여 발명을 한 종업원 사이에 합리적인 이익배분을 함으로써 사용자로 하여금 보다 적극적인 투자를 유도하도록 하고, 종업원에게는 창조적인 발명을 할 동기를 부여하여 산업발전에 이바지하기 위해 직무발명에 관한 규정을 두어 사용자와 종업원 간의 관계를 규율하고 있다.
나아가 우리나라를 포함한 많은 나라들이 미국의 베이돌 법(Bayh-Dole Act)의 입법에 따라 국가연구개발사업의 연구성과물에 대하여 국유특허의 원칙을 양보하고 대학 등 연구기관에게 특허권을 인정하여 발명의 고양과 사업화를 촉진하고자 하였다. 그러나 베이돌 법이 연방기금으로 창출된 발명의 상업화를 촉진시켰다는 평가를 받고 있더라도, 미국과는 다른 국가에서 베이돌 식의 법령이 미국과 유사한 효과를 거둘 것인가에 대해서는 의문을 제기하는 목소리가 높다. 특히 우리나라는 국가연구개발 사업으로부터 얻어진 특허 등 성과물이 특허출원건수 등 양적인 면에서 크게 성장하였음에도 불구하고 민간으로 이전되지 않고 사장되는 미활용특허가 상당수에 이르는 등 국가연구개발사업 성과의 효율성에 대한 문제가 지속적으로 지적되고 있는 것이 현실이다.
본고는 상기와 같은 국가연구개발사업의 문제에 주목하여 국가연구개발사업의 성과를 제고하는 방안을 모색해 보고자 한다. 특히 직무발명제도를 통하여 국가연구개발사업의 효율성을 제고할 수 있는 방안을 모색해보고자 하였다.
지금은 연구자들의 지식재산의 창출을 보호·장려하고 그 이용을 도모함으로써 기술의 발전을 촉진하고 산업발전과 국부창출이 가능한 나라만이 살아남는 무한경쟁의 시대이다. 연구자의 소중한 연구성과와 많은 비용을 투자한 사용자와의 이익균형을 위해 탄생한 제도가 직무발명임을 고려해 볼 때, 연구성과에 대한 수익을 합리적으로 배분될 수 있도록 직무발명 제도를 운용하는 것이 중요한 문제이다.In recent years, the importance of 'knowledge based economy' has opened and Institute and Private company has been experiencing economic growth due to its investment in science and technology and entrepreneurial ideals. How to contribute to the profit of In-service Invention between employee and employer has emerged as an important issue among the inventors. There is a law which is called EMPLYOEE INVENTIION ACT of 2006 regarding in this matter. This Act enact two critical provision about Invention-for-Hire system. (1) A company that does not have a provision or agreement with employer expressed or implied, which employee state not assign Invention-for-Hire, it has a non-exclusive, royalty-free license right. (2) Nevertheless, Employer has not transferred employee inventions, if this invention meet the requirements, it can be considered Invention-for-Hire and employee must make amends for Employee Inventions.
And many countries, including Korea, are implementing Bayh-Dole-like legislations for the purpose of improving the efficiency of R&D programs operated with national or federal funds. Although one may admit that Bayh-Dole as originally adopted in the United States was effective in bringing into the market patents made in universities, a lingering question is that laws similar to Bayh-Dole may not have the effects as such in different situations, that is, in different counties. In fact, a number of studies point out inefficiency of Korean R&D programs funded by the Korean government.
Pursuant to the basic framework of the Invention-for-Hire system, this note uses for analysis two fundamentals that support the Invention-for-Hire system: incentive given to employer in the form of entitlement to obtain patent or otherwise property rights over the invention by employee; and incentive given to employee in the form of reward for invention made by herself.
Employees of firms could be compensated for their efforts. The firms also can earn returns on the investments by Invention-for-Hire. The most significant point in Employee Inventions are check and balance. It is necessary for us to keep a balance between "Employee's profits" and "Employer's interests".
