지난 2013년 3월 5일, 미국 상원 소속 규제개혁 심사위원회(U.S. House of Representatives Committee on the Judiciary Subcommittee on Regulatory Reform)에서는 “행정입법심사법”(H.R. 367, the “Regulations from the Executive In Need of Scrutiny Act of 2013”, 이하 REINS 법안)에 대한 청문회가 열렸다. 동법은 정부에서 제정하는 행정입법 중 일명 “중요한 행정입법”(Major Rule)에 한하여 양원 모두로부터 적극적 승인(Affirmative Action)을 받도록 규정한 것으로 미국 연방법전 제8장 제5절에 대한 수정안을 내용으로 하고 있다. 법안은 특히 지난 2011년에 의회에 제출되었으나 입법이 좌초되었다가 다시한번 제안된 것으로 현재 미국의 주요 논의사항으로 관심을 받고 있다.
미국 의회는 1996년 의회심사법(Congressional Review Act, 이하 CRA)을 제정하여 정부의 행정입법에 대하여 60일 이내에 의회가 승인거부를 할 수 있음을 규정하였다. 법에 따라 1996년부터 2008년까지 총 731건의 중요한 행정입법이 제출되어 2001년 한 차례 부인결의가 이루어졌다. 한편, 최근 경제성장 둔화에 대한 대응책으로 미국 행정부는 예산감축제도인 시퀘스터(Sequester)를 발령하는 등 정부재정을 감축하기 위하여 정책을 제안하고 있다. 이러한 상황에서 동 법안은 규제개혁을 통한 예산감축과 행정부에 대한 의회적 통제를 목적으로 제안된 것으로 보인다. 하지만 REINS 법안의 합법성과 실무적 효율성, 나아가 위헌성에 관한 논란이 제기되고 있다. 결과적으로 1983년 미국 연방대법원이 입법거부권(Legislative Veto Right)을 위헌으로 판단하고, 1996년 의회에서 CRA를 제정한 이후 다시 의회심사제도에 관한 행정법적 논의를 불러일으킨 것이다.
의회의 입법거부권에 관한 논의는 우리나라에서도 의미가 있다. 지난 2000년 국회법 제98조의 2의 개정당시 의회에서 행정입법에 대한 동의권 유보제도를 도입할 것을 논의하였으나 행정부의 반대로 행정입법의 의회 제출만을 규정한 ‘상임위원회의 행정입법 검토 및 의견통보제도’가 제정되었다. 우리나라의 행정입법송부제도와 미국의 CRA는 행정입법 제정과정에서 의회의 통제를 가능하게 하였다는 측면에서 유사하지만 미국의 CRA는 의회의 동의거부를 인정하였으므로 우리나라의 국회법 제98조보다 의회에 실질적인 권한을 부여한 것으로 보인다.
우리나라의 의회심사제도 논의에 있어서 입법권자는 헌법의 범위 내에서 국민의 의사를 반영하여 현행 법률과 의회의 현실에서 실현가능한 방안을 선택하여야 할 것이다. 따라서 현행 상임위원회의 행정입법 검토 및 의견통보제도는 적어도 동의권을 유보함으로써 제도의 본질적 의미를 살리되, 미국 CRA와 REINS법에서 제안하고 있는 절차, 즉 중요한 행정입법에 대해 법률과 같은 입법절차를 도입하거나 동의결의 되지 않는 한 무효로 하는 방안에 대해서는 1) 중요한 행정입법에 대한 기준의 불명확성, 2) 의회승인 지연이 국민에게 미치는 영향, 3) 권력분립구조에서의 논의를 종합적으로 고려하여 보다 신중하게 접근하여야 할 것이다.On March 5, 2013, U.S. House of Representatives Committee on the Judiciary Subcommittee on Regulatory Reform held a hearing for the “Regulations From the Executive in Need of Scrutiny Act of 2013 (“REINS act”) (H.R. 367). The Act, which includes the revision regarding to the U.S. Code Title 8 Section 5, was to require “Major Rules”to have affirmative approval from both Congress. This Act was failed to be enacted by the congress in 2011, but resubmitted to the congress in 2013, therefore it intrigues a lot of attention from the Administrative law scholars.
US congress enacted Congressional Review Act (“CRA”) in 1996, but it was not actually effectively used except once from 1996 to 2008. However, the Act was supported because it gives second chances to reconsider to the suggested rules. In this situation, REINS Act seems important because it gives more power to nullify the rules when they are not approve.
However, there are some controversies to the constitutionality, legitimacy and effectiveness of this act. The Constitutionality was stem from the INS v. Chadha case in 1983, which held that the legislative veto act unconstitutional. This Act is revised to the CRA, but REINS act seems more likely to the legislative veto. Moreover, it is criticized because the Congress might not prove Major Rules after sincere reviews.
This Act gives implications to Korea as it is one of the important issues of Administrative law. Congress of Korea enacted CRA except the right to approve or disapprove. This system has been criticized as it is not act as it supposed to be. More diverse approaches to revise CRA considering the controversies regarding REINS Act of USA.
