우리 헌법재판소는 타인의 인격권내지 사생활의 자유와의 충돌과 관련하여, 공적 인물의 공적 활동에 관한 신문보도가 명예훼손적 표현을 담고 있는 경우 언론자유와 명예보호의 이익조정의 기준에 대하여 논의하면서, 신문보도의 명예훼손적 표현의 피해자가 공적 인물인지 아니면 사인인지, 그 표현이 “공적인 관심 사안”에 관한 것인지 순수한 사적인 영역에 속하는 사안인지, 피해자가 당해 명예훼손적 표현의 위험을 자초(自招)한 것인지, 그 표현이 객관적으로 국민이 알아야 할 공공성·사회성을 갖춘 사실(알권리)로서 여론형성이나 공개토론에 기여하는 것인지 등을 종합하여 구체적인 표현 내용과 방식에 따라 상반되는 두 권리를 유형적으로 형량한 비례관계를 따져 언론의 자유에 대한 한계 설정을 할 필요가 있는 것이라고 판단하였는 바, 헌법상 보호를 받는 표현의 단계적 분석으로서 마지막 이익형량의 단계이전에 공적 사안의 해당여부가 우선적으로 판단되어야 함을 명시하였다. 그러나 공적 사안이 무엇이며 어떠한 기준으로 판단되는 지에 대한 논의는 아직까지도 활발하게 이루어지지 못하고 있다. 미국에서는 공적 사안을 세 가지의 경로를 통하여 판단하고 있는데 우선 내용적 분석으로는 공동체관심사기준(Community Concern)과 보도가치기준(News Interest)을 들 수 있다. 우선 표현이 객관적으로 혹은 공정하게 사회공동체의 정치적, 사회적, 기타 관심사에 관련된다고 간주될 수 있는 지를 판단하는 공동체관심사기준(Community Concern), 그리고 두 번째로 표현이 합법적 보도가치를 가지는 대상인가 즉, 대중에게 중요하고 가치 있는 대상 그리고 일반적인 관심의 대상이 되는 지를 판단하는 보도가치기준(News Interest)이 바로 것이다. 두 번째로는 방법적 분석으로서 공적 사안에 적합한 지를 전체적인 기록들에서 드러나는 내용·형식·표현의 문맥을 통하여 분석하여야 한다는 것이다. 세 번째로는 단계적 분석으로서 공적 사안을 단순한 공적 사안, 실질적인 공적 사안 그리고 태생적 공적사안을 분류하여 입증책임이나 이익형량에 있어서 차이를 주는 것이다. 이러한 공적 사안에 대한 미국에서의 논의는 우리에게 시사하는 바가 크다고 본다.In Snyder v. Phelps, the Supreme Court suggested the standards of "matter of public concern" which is a important factor to protect the speech under the First Amendment.
In the first place, the Supreme Court in Snyder explained a set of three factors courts are required to consider when deciding if speech involves a matter of public concern, that is to say: (1) content of the speech; (2) form of the speech; and (3) context of the speech.
The standard to decide what a matter of public concern is contains two tests. The one is "Community Concern Test" that the speech which is“fairly considered as relating to any matter of political, social, or other concern to the community” constitutes a matter of public concern. The other is "News Interest Test" that the speech which centers on a subject of legitimate news interest and a subject of general interest and of value and concern to the public is also considered a matter of public concern. But the Supreme Court failed to articulate the differences between "Community Concern Test" and "News Interest Test" because this leaves several unresolved questions that now must be resolved in the future. Nevertheless, these tests can be good guideline to determine what the public concern means and need to be made more detailed.
In the cases in U.S, there are three levels of matter of public concern: (i) matter of public concern; (ii) substantial matter of public concern; and (iii) inherent matter of public concern. these In Korea, there have not been debates about "public concern" due to short history of the freedom of expression. The discussion on a matter of public concern in U.S may be helpful for us to protect the freedom of expression.
