사회생활에서 일어나는 사인간의 분쟁은 종국적으로 법원의 재판에 의하여 해결되는 것이 원칙이나 이는 비용과 시간이 많이 드는 단점이 있어 법원의 재판을 보완하거나 대체하는 새로운 분쟁해결 방식으로 대안적 분쟁해결방식(Alternative Dispute Resolution: ADR)이 등장하게 되었다. 이러한 ADR의 일종으로서 개인정보분쟁조정은 개인정보를 침해당한 당사자와 침해를 야기한 당사자간의 분쟁에 대해 합리적이고 원만한 해결방안을 제시하여 당사자간 합의를 유도하는 제도로서 개인정보보호법에 규정되어 있는 법정제도이다.
최근 개인정보보호법상 쟁점중 하나가 동일한 사안에 대해 소송이 진행 되는 중에 제기된 분쟁조정을 어떻게 처리할 것인지에 관한 것이다. 소송 진행과는 관계없이 위원회는 분쟁조정을 독자적으로 진행한다는 입장과 법원의 소송상 판단이 있기까지 조정절차를 중단하자는 입장이 있다. 이 경우 분쟁의 성질상 위원회에서 조정하는 것이 적합하지 아니하다고 인정하여 조정을 거부하는 것이 타당하며, 향후 이를 입법화하는 것을 고려할 수 있다고 본다.
또한 최근 개인정보의 침해의 집단성을 대비하여 집단분쟁조정을 도입하여 시행하고 있으나 거의 이용이 되지 않고 있는 실정이다. 집단적 성격의 개인정보분쟁의 경우 절차 진행에 과다한 시간과 비용이 소요됨은 물론 조정결과도 한쪽 당사자가 불수락할 것이 거의 확실하는 점에서 분쟁조정 제도의 취지에 부합하지 않는 측면이 있다. 따라서 개인정보분쟁조정은 소규모의 개인정보 분쟁 사건에 초점을 맞추는 것이 타당하다고 본다. 집단적 성격의 분쟁은 행정부보다는 사법부에 어울리는 분쟁이라고 볼 수 있으며, 최종적 법해석과 강제력 있는 결정을 할 수 없는 행정부가 집단적 성격의 분쟁에 치중하는 것은 정보주체의 권리구제 차원에서든 행정부와 사법부의 권력분립 차원에서 바람직스럽지 않다고 할 수 있다.In principle, disputes occurring between private parties are to be resolved by court adjudication. Due to the cost and time involved, however, alternative dispute resolution (“ADR”) has been introduced to either supplement or substitute court adjudication. Personal Information Dispute Mediation, which is one type of ADR, is a justice system stipulated under the Personal Information Protection Act (“PIPA”) that seeks to induce a settlement by proposing a reasonable and amicable solution to a dispute between one party which has suffered a breach of personal information and the other party that has caused such breach.
One of the recent issues under the PIPA is how to handle the dispute mediation that has been initiated while a lawsuit is pending on the same subject matter. There are two positions: on the one hand, the Committee will independently carry out the dispute mediation irrespective of the progress of the lawsuit; while on the other, the mediation process is to be suspended until the court has reached a decision. In this case, it would be more appropriate for the Committee to refuse to mediate the case, in recognition of the fact that it would be improper for the Committee to mediate the case in light of the nature of the dispute.
Further, although the collective alternative dispute resolution system has been introduced recently to respond to large-scale breach of personal information, the system is almost not being used. Large-scale disputes concerning personal information require not only excessive costs and time in terms of procedure, but it is almost certain that one party will not accept the mediation outcome. As such, the system does not conform to the underlying objective of the dispute mediation system. For this reason, it would be more appropriate for the personal information dispute resolution system to focus on small disputes concerning personal information. Large-scale disputes are better suited to the judiciary than the executive branch; it would not be desirable for the balance of power between the executive branch and the judiciary for the executive branch (that cannot ultimately interpret the law or issue a binding decision) to concentrate on large-scale disputes.
