현대사회에서 의료 개념의 외연은 ‘질병이 없는 상태’와 같이 소극적인 의미를 넘어서, 아름다움, 행복, 웰빙, 삶의 질을 포함하는 적극적인 의미로 확장되고 있다. 또한 현대사회에서 의료는 의료서비스의 상품화와 비인간화, 환자의 소외 등과 같은 ‘현대 의학의 위기’를 직면하고 있다. 이러한 현상은 의료, 건강, 질병이 사회문화적 맥락에서 논의되어야 할 필요성을 증대시키며, 이에 따라 의료사회학과 같은 학제 간 연구가 증대되었다. 이 논문에서는 특히 법학에서 아직 충분히 소개되지 않은 개념인 ‘의료화’에 대한 비판적 고찰을 통해 의료법과 보건의료정책이 나아가야 할 방향성을 구상해보고자 한다. 의료화는 이전에 의료의 문제로 받아들여지지 않았던 문제들이 질병 내지 장애로 인식되고, 정의되고, 다루어지기 시작하면서, 이전에 의료 영역 밖의 일상적 삶의 차원에 놓여있었던 행위와 상태가 의료적인 문제로 설명되는 현상 및 과정이라고 할 수 있다.
이 논문에서는 의료화의 역사적 전개를 세 단계로 나누어 살펴보고 있다. 다시 말해, 의료화는 i) 근대화의 과정 속에서 의료화; ii) 현대사회에서 권력(보건의료행정)과 자본(의료산업)에 의해 추진되는 의료화; iii) 의료화에서 생명의료화로의 역사적 이행이라는 세 가지 역사적 맥락에서 설명될 수 있다.
의료화의 역사적 지평에 대한 법사회학적 반성을 통해 이루어지는 새로운 의료법패러다임의 방향성은 의료화와 탈의료화의 변증으로 나아가는 것이라고 볼 수 있으며, 이 논문에서는 이러한 변증의 가능성을 의료인류학과 의료다원주의적 관점에서 바라보고자 한다. 특히 의료다원주의적 관점은 표준화된 의료행위의 한계를 교정하고 의료문화의 가치를 회복하는데 중요한 시사점, 특히 현행 무면허의료행위 규제에 대한 새로운 성찰을 제공해줄 수 있을 것이다. 이를 통해 근대 의학과 전통 한의학, 그리고 제도권 의료에 담겨지지 않은 비공식적인 보완대체의료의 다원주의적 협업에 대한 법정책이 논의될 수 있을 것이다.This essay looks into the history of medicalization, the concept, which has been mainly discussed in sociology, but has not been fully introduced in jurisprudence yet. This essay discusses three phases of historical evolution of medicalization. First, medicalization has been developed through overall modernization process. Through the entangled process between modernization and medicalization, modern medicine, medical scientific knowledge and medical profession have increased their power as active agency of social control. Furthermore, in post-industrial society, medicalization process is propelled by Power(health care administration) and Money(medical industries). Lastly, our contemporary society moves forward into the third historical phase of medicalization, which can be described as the shift from medicalization to biomedicalization.
There are numerous criticisms on medicalization process. To resolve the tension between medicalization and demedicalization, I suggest a medical-legal pluralistic perspective, based on the theoretical foundation of medical anthropology and medical pluralism. This perspective may provide us a new reflection on the current regulation of unlicensed medical practice, the culturality of medicine, therapeutic dialogue, and the cooperation between physicians and non-physician complementary and alternative medicine(CAM) providers. The cultural aspects of medicine request interdisciplinary research such as medical humanities. This integrated understanding going beyond the boundary of discipline is integral especially in the area of medical law and health care policy.
