최근 상표권침해소송에서 대법원 2012.1.9.선고 2010다95390판결을 통해 무효사유가 존재하는 특허권의 행사를 권리남용으로 보아 특허권의 행사를 제한한 것에 이어, 대법원 2012.10.18.선고 2010다103000판결에서는 무효사유가 존재하는 상표권의 행사에도 권리남용의 법리를 적용하여 그 행사를 제한하는 태도를 취하기에 이르렀다. 이러한 대법원의 태도에 있어서 소송경제 및 재판의 신속성을 이유로 들며 찬성하는 견해도 존재하나 성문법 체계의 우리나라의 법체계하에서는 개별적ㆍ구체적ㆍ예외적인 특수한 상황 아래서만 적용되어야 할 것이다. 이러한 적용의 남발을 피하기 위해서는 민법상 권리남용의 적용요건을 충족하는 예외적인 경우에만 사용되어야하며 그것이 판례의 일관된 태도인바, 이러한 기존의 판례의 태도에 따라 객관적 요건 및 보충성 요건을 충족하는지가 문제가 된다. 대법원 2010다103000판결은 이상과 같은 권리남용행위의 인정여부에 대한 검토없이 무효사유가 있는 상표권의 권리행사를 권리남용으로 인정했다는 비판이 있을 수 있다. 또한 보충성 요건을 만족시키지 못하므로, 권리남용의 적용이 타당하지 않은 것이라는 비판이 제기될 수 있는데, 그 이유는 상표법은 상표법 제51조를 두어 상표법 제6조 제1항에 관한 무효사유가 존재하는 상표권의 효력을 직접 제한할 수 있다. 그러므로, 이러한 사유가 존재하는 상표권의 행사의 경우에는 상표법 제51조를 적용하여 그 효력을 제한함으로서 문제를 해결하면 될 것이고, 권리남용의 법리를 적용할 필요가 없을 것이다. 이에 비추어 보면 최근의 대법원 2010다103000판결에서는 원고의 등록상표 및 서비스표가 제6조 제1항 제3호 및 제7조 제1항 제11호에 해당됨에 명백성이 있으므로, 이러한 상표권의 행사는 권리남용으로 볼 수 있어 정당한 권리행사로 볼 수 없다고 판시하였는바, 이와 같이 제6조 제1항 제3호에 해당하는 부분이 있는 경우에는 상표법 제51조의 적용으로 원고의 상표권의 효력을 제한하여 권리행사를 인정하지 않는 것이 타당하고, 이러한 해결방안이 있음에도 불구하고 굳이 권리남용의 법리를 적용하여 해결한 것은 재판편의주의 및 일반조항으로의 도피라는 비판을 받을 수 있는 것이다.Recently the Supreme Court restricted the exercise of the patent right which has grounds of invalidation based on the abuse of right(Supreme Court Decision No.2010Da95390; January 19. 2012). Subsequently Supreme Court applied the principle of abuse of right to the exercise of the trademark right(Supreme Court Decision No.2010Da103000; October 18. 2012). There are views that supporting the stance of the Supreme Court based on the judicial economy and speed of the judicial proceedings. However, the principle of abuse of right should be applied only in special circumstances individually, concretely, exceptionally since Republic of Korea is taking the statutory law system.
There are two requirements for the principle of abuse of rights - objective principle and supplementary principle. From this point of view the Supreme Court Decision No.2010Da103000; October 18. 2012 can be criticized which did not review the objective principle and did not consider the supplementary principle.
Regarding the lack of the supplementary principle, unlike the Patent Act, the Trademark Act can restrict the effect of the trademark right which has grounds of the invalidation are prescribed in the 6(1)1, 2, 3 and 4 of the Trademark Act, directly in accordance with Article 51. Therefore, the exercise of the trademark right which has grounds of the invalidation can be restricted by applying the Trademark Act Article 51 instead of the principle of abuse.
In this respect, the Supreme Court Decision No.2010Da103000; October 18. 2012 can be criticized that it is judgmental expediency and escape to generalklausel. Because the Supreme Court rendered that since it is clear that registered mark and service mark of plaintiff are conform to 6(1)3 and article 7(1)11 of the Trademark Act, the exercise of trademark is not the exert of a just right but the abuse of right. In conclusion, if 6(1)3 of the Trademark Act can be applied, it is right to restrict the trademark right of plaintiff in accordance with the Trademark Act article 51 not by the principle of abuse of right.
