권리로 인정되고 나서 그 권리에 대한 침해행위에 대하여 민사상 구제수단으로 가장 중요한 것은 손해배상과 금지청구인 것은 주지의 사실이다. 전자는 과거의 침해로 인한 손해를 배상함을 목적으로 하고, 후자는 장래를 향하여 현존하는 침해의 장래 효력을 배제하거나, 장래 침해행위를 방지하기 위한 기능을 하고 있어 양자가 중첩적으로 적용될 수 있다. 그러나 영미법계와 대륙법계의 경우 주로 그 연혁적 이유로 말미암아 영미법계에서는 손해배상에 대한 금지청구의 열위성을 나타내는 회복불가능성의 요건이 정립되어 활용되어 왔고, 대륙법계의 경우는 구제수단은 권리의 효력으로 파악하여 해당 권리의 근거규정에 명시적으로 규정되지 않은 경우에는 매우 제한적으로 이를 인정해 오고 있었다. 하지만 미국 등지에서 1960년대 이후로 법경제학 연구가 발전되면서 권리보호의 가장 원칙적 형태가 금지청구여야 함을 밝혀 왔다. 왜냐하면, 금지청구를 통하여 권리자는 동의 없는 거래
를 할 필요가 없어지고, 협상을 통하여 재화를 가장 높게 평가하는 자에게 배분되는 배분적 효율성을 잘 달성할 수 있기 때문이다. 하지만 거래비용이 높을 경우 최초 권리배분이 효율적이지 못할 경우에는 거래를 통한 배분적 효율의 달성이 불가능한 상황이 발생하기 때문에 손해배상만의 인정을 통한 강제적 거래형태를 인정해 줄 필요가 있기 때문이다. 이런 법경제학의 발전에 따르면 영미법상의 회복불가능성 원칙은 금지청구의 손해배상에 대한 열위성을 인정한다는 점에서 잘못된 것이다. 나아가 영미법상에서는 금지청구의 요건으로 부당한 곤란성이란 요건을 추가적으로 요구하고 있다. 이런 영미법상의 금지청구 요건사실 운용과 최근의 수정은 우리나라의 경우 많은 시사점을 제시한다. 특히, 최근 일조권, 조망권 등에서 아주 제한적으로 금지청구를 인정하면서도 금전배상으로 회복불가능할 것이란 요건을 추가하려는 일부 판결들이 생산되면서 영미법계에서 이미 폐기된 회복불가능원칙의 운용의 잘못된 전철을 밟아서는 아니된다There are several remedial measures for the infringement of entitlements including criminal punishments, administrative sanctions, and private enforcement measures. Among private enforcement measures, damages and injunctive relief are most popularly used. We enforce law to aim at retaliation and deterrence. To deter, violators should be punished up to the maximum magnitude [??benefit (or damage)×probability of conviction+reasonable deterrence margin]. Of course the maximum magnitude can be depreciated by the consideration of policy. To remain the maximum, enforcement measures can be replaceable with their equivalence. For a voluntary exchange, injunction is required to be dominating remedy. But, in common law countries, injunctive reliefs is subordinate to damages. The requirement of irreparable injury for injunction originated historically to reflect on its subordination. However, Douglas Laycock reviewed more than 14,000 remedy cases and
declared that the irreparable injury rule in common law is almost dead. He made clear that the irreparable injury rule doesn’t mean irreplacceable, inadequate at law but means adequacy of injunction itself. Furthermore, in civil law countries including Korea, injunctive reliefs are rarely recognized without statutory athority. There are few exceptions such as basic human rights. By researching those weakpoints of every jurisdictions, we need to apply injunction on the allmost all infringement of entitlements.
