One of the main topics being discussed at the Doha Development Agenda “( DDA”) negotiations is the proposed amendment of the Understanding on Rules and Procedures Governing the Settlement of Disputes (“DSU”). The gist of the DSU amendment negotiation is to introduce more procedural guidelines, safeguards and hurdles, much more similar to domestic litigation procedures.
One of the key issues being discussed at the DSU amendment negotiation is the introduction of the “remand” procedure. The remand procedure is a mechanism through which the WTO Appellate Body can send a case back to an underlying panel to complete the analysis based on a proper jurisprudence as pronounced by the Appellate Body, or to gather further factual information and complete factual analysis as necessary. Most of the appellate courts in domestic litigation systems do have a remand authority as most of the time this is how a dispute is resolved. Surprisingly, however, the current DSU does not have a remand system. All the Appellate Body is authorized to do is to uphold, modify or reverse a panel decision. As an appellate court, it cannot send the case back to the panel for further discussion. At the same time, the Appellate Body cannot engage in its own fact finding mission. Fact gathering and analysis are entirely within the authority of the panel and the Appellate Body can only review legal errors committed by the panel.
So, the combination of the two inherent limitations basically means that the Appellate Body cannot embark on its own factual analysis and only the panel can do it, but that there is no way for the Appellate Body to ask the panel to carry out a new or different factual analysis in the same dispute. If the Appellate Body does not like the panel’s decision, all it can do is to reverse the decision. The problem arises when the Appellate Body reverses the jurisprudence or methodology adopted by the panel. In this kind of situation, the Appellate Body simply reverses the panel’s conclusion and the case terminates once and for all.
Since the problem of the lack of remand has been showcased by many disputes, there seems to be consensus among the membership at the DSU negotiation table as far as remand is concerned. In light of the obvious consensus, the chairman of the DSB amendment negotiation provided his own proposal for remand. The proposal, however, seems to have a fundamental problem; it presupposes two separate decisions for the same case when the remand mechanism is utilized.
More particularly, the chair’s proposal for the remand system apparently contains fundamental problems which may nullify all the intended benefits of the remand system. Under this scheme, there will be two different sets of reports for the same case under the chair’s text’s scheme. The existence of multiple reports would probably prolong the dispute rather than shorten it, because practically the losing Member will not or cannot implement the previous DSB ruling and recommendations unless and until the subsequent decision is rendered through a remand, at which point it could have a full grasp of the implementation obligation. At the same time, the likely conflict between the two decisions may even hinder final settlement of the dispute.
Such being the case, a more appropriate remand system in the WTO dispute settlement procedure context would be the system where only one report is finally adopted. In this system, the Appellate Body procedure may be put on hold during the pendency of the remand procedure. Once the panel passes on its decision on the remand issue to the Appellate Body, it can go on and make a final decision at the end of the day. This system of single and comprehensive decision may better serve the interest of the Members in the WTO dispute settlement procedure.2001년 이래 진행되고 있는 도하라운드 협상의 중요한 분야 중 하나는 WTO 분쟁해결절차를 개선하기 위하여 현재의 WTO 분쟁해결양해사항“( DSU”)을 어떻게 개정할 것인가 하는 문제이다. 미국, 일본, EC, 중국, 브라질 등 주요 국가 대표들 참여하에 DSU 개정을 위한 협상이 지속적으로 진행되어 오고 있으며, 이 과정에서 국가들 간 적지 않은 입장차이가 확인되고 또 조율되고 있는 상황이다.
DSU 개정협상에서 다양한 쟁점이 논의되고 있으나 중요한 핵심쟁점 중 하나는 WTO 항소기구(Appellate Body)에 대하여“파기환송”(remand) 권한을 새로이 도입할 것인지, 도입한다면 어떠한 모습으로 도입할 것인지 하는 문제이다. 각국의 국내 사법체제에서 항소법원이 일반적으로 보유하는 파기환송 권한이 WTO 항소기구에는 부여되어 있지 않아, WTO 출범이래 적지 않은 분쟁에서 주요 쟁점이 당사국이 만족할 수 있는 수준의 종국적 해결에 이르지 못하고 의문점을 그대로 남겨 두는 애매모호한 결정만 남게 되는 사례가 자주 발생하여 왔다. 이러한 문제점을 극복하고자 현재 적지 않은 국가들이 파기환송제도 도입을 찬성하고 있는 것으로 파악되고 있다. 2008년 DSU 개정 협상을 담당하는 WTO 특별회의 의장은 파기환송제도를 포함한 DSU 개정협상의 제반 쟁점에 대한 그간의 논의에 기초하여 자신의 초안을 회람한 바 있다.
그런데 이 초안에 포함된 파기환송제도는 다소 독특한 내용을 포함하고 있다. 즉, 항소기구가 특정 사안을 하급심인 패널로 파기환송하는 경우에도 파기환송되는 일부 이슈를 제외한 여타 쟁점에 대해서는 종전과 같이 종국적 결정을 그 시점에서 내리고 이러한 결정은 패소국의 이행단계로 진행한다는 것이다. 그러므로 특정 분쟁에서 설사 파기환송이 발생하더라도 그 분쟁 자체는 지금의 경우와 마찬가지로 그 시점에서 최종 결정이 이루어지고 이에 대하여 패소국은 이행책임을 부담하게 된다는 것이다. 그리고 파기환송 심리는 별도의 사건으로 패널 심리, 항소기구 심리를 거쳐 다시 별도의 결정으로 채택되고 여기에 대하여 또 패소국은 필요시 이행책임을 부담하게 된다는 것이다. 결국 동일한 사건에 대하여 복수의 결정문이 채택되는 것이 의장 초안 파기환송제도의 골자이다.
의장 초안이 이러한 내용을 담게 된 취지는 파기환송 심리로 인하여 기존의 분쟁의 해결이 지연되어서는 아니 된다는 고려에 기초한 것으로 보인다. 파기환송에 짧게는 90일, 길게는 6개월에 걸쳐 시간이 소요될 것으로 예상되므로 그만큼 분쟁해결이 지금보다 지연되는 측면이 있는 것은 사실이다. 그러나 의장 초안대로 동일한 사건에 대하여 두 보고서를 각각 채택하는 상황을 현실적 측면에서 검토하여 보면 결국 항소기구 최종 결정이라는 것은 형식적인 외양에 불과하고 분쟁의 실제적 내지 궁극적 해결은 파기환송 심리가 끝나는 시점까지 결국은 미루어질 수밖에 없다는 것을 알 수 있다.
즉, 두 가지 결정문을 순차적으로 채택하는 체제에서는 최초 심리를 통해 최종 결정이 도출되고 이 결정이 패소국의 이행단계로 진행한다고 하더라도 해당 분쟁의 중요한 쟁점이 아직 파기환송 심리에서 다루어지고 있는 상황에서 과연 패소국이 최초 심리에서 도출된 최종 결정에 의거하여 신속히 이행절차로 돌입할 것인지 또는 돌입할 수 있을 것인지는 심히 의문이다. 패소국 입장에서는 파기환송 심리가 진행되고 있는 상황에서는 자신이 궁극적으로 이행의무를 여전히 부담하게 될 것인지, 아니면 이행의무의 구체적 범위가 최종적으로 어떻게 정하여질 것인지 정확하게 알기가 힘들기 때문이다. 파기환송 심리를 통하여 최초 결정의 내용이 번복되거나 수정되는 상황도 충분히 예측가능하기 때문이다. 그렇다면 최초 심리에서 패소한 피제소국은 소송절차 지연을 위한 특단의 악의를 갖고 있지 아니한 경우에도 최소한 파기환송 심리 계류 중에는 이행의무를 부담할 수 없다는 점을 설득력 있게 WTO DSB에 제시할 수 있을 것이다.
나아가 이와 같이 동일한 사안에 대하여 두 가지 결정문을 도출하는 제도는 결국 양 결정문 간 법리의 직·간접 충돌, 이행의 선후 문제, 21.5분쟁 등 후속절차의 기산시점 산출 문제 등 다양한 문제점을 노정하게 될 것이다. 이러한 문제점들은 지금과 같이 동일 사건에 대한 단일의 결정문 도출 시스템하에서는 발생하지 않을 사항들이다. 결국 의장 초안에 포함된 파기환송제도는 분쟁의 신속해결에도 별 도움을 주지 못할 뿐 아니라 복수의 결정문 채택으로 혼선만 가중시킬 우려가 있는 것으로 보인다.
따라서 이왕 파기환송제도를 도입하기로 하는 마당이라면 일반적인 사법제도하에서의 파기환송 개념에 충실하게 동일한 사건에 대해서는 하나의 종합적인 결정문이 도출되도록 하는 제도를 도입하는 것이 바람직하다. 이 경우 항소기구가 파기환송제도를 통하여 하급심인 패널에 추가 또는 새로운 심리를 명하고 그 기간 동안 항소기구 최종 결정을 중단시키면 될 것이다. 하급심의 추가 심리가 종료되면 이를 받아 항소기구가 최종 결정을 내리게 되면 그만큼 다소 시간이 지연되더라도 해당 사건에 대한 종합적이고 포괄적인 결론을 도출할 수 있을 것이다. 여기에 대하여 승소국이나 패소국도 후속절차로 일관성 있게 진행할 수 있을 것이다. 따라서 WTO 회원국은 차제에 이러한 방향으로 파기환송제도 도입을 검토하는 것이 필요하다고 판단된다.
