상설적인 국제형사재판소의 설립은 20세기와 21세기 국제공동체에서의 법의 지배의 확산이라는 측면에서 주요한 성과로 평가된다. 국제형사재판소는 주요하고 심각한 국제범죄인 전쟁범죄, 인도에 반하는 죄, 제노사이드범죄 및 침략범죄를 관할범죄로 하여 그러한 범죄를 저지른 자들을 처벌함으로써 국제공동체에 있어서의 이들 범죄의 처벌과 예방에 기여하고 나아가 국제평화에 이바지 할 것으로 기대된다.
이러한 맥락에서 이 글은 2002년 설립된 국제형사재판소가 8년의 기간 동안 어떠한 활동을 하였는지를 조망하고 평가하고 나아가 분권화된 국제공동체에서 국제형사재판소가 직면하고 있는 당면문제가 무엇인가를 살피고 있다. 이를 통해 국제공동체에서의 보다 실효적인 국제형사정의를 실현함으로써 국제평화를 확보하기 위한 방안을 모색하기 위한 국제형사법분야에서의 최근의 과제와 논제를 살펴보고자 한다. 이에 이 글은 크게 국제형사재판소의 활동현황을 조망하는 부분과 국제형사재판소가 당면하고 있는 문제들에 관한 부분으로 나누어 이를 살피고 있다.Establishment of a permanent international court for international criminal justice is regarding one of the splendid achievements of rule of law in international community in 20th century. Under the Statute of the Court, the International Criminal Court (hereinafter“the ICC”) may exercise its own jurisdiction on most serious international crimes: War Crimes, Crimes against Humanity, Crime of Genocide and Crime of Aggression. And the ICC may play an important role to proscribe its own jurisdictional crimes and to make those persons who engage in such conducts criminal liable. By doing so, it is anticipated for the ICC to contribute toward enhancing the World Peace and security.
However, there have been several critics among law scholars and they have been worried about the teething stage of the practice of the ICC. In this context, this article deals with two main issues: what the ICC has done since its establishment and what are the current legal and practical issues for the efficient works of the ICC. Based upon the research on such two issues, this article aims to provide the desirable proposals for more efficient future works of the ICC. Concerning the current issues on the works of the ICC, this article deals with (1) cooperation between States and the ICC, (2) selective justice practice problems, (3) speedy and fair trial issues, and (4) peace and justice problems in international criminal law policy.
