착오는 당사자가 잘못된 정보를 가져서 생기는 것이다. 어떤 경우에 착오에 의한 법률
행위의 취소를 인정할 것인지와 관련한 법원칙은 당사자들의 정보취득과 정보교류 등에
영향을 미친다. 바람직한 착오 관련 법원칙은 사회적으로 유용한 정보가 더 적은 비용으로
취득되도록 하고, 사회적으로 가치가 없는 재분배적인 정보가 지나치게 많이 생산되는 것
을 막으며, 정보를 필요로 하는 당사자에게로 정보가 원활하게 교류되도록 하고, 더 적은
거래비용으로 재화·용역이 최고가치 평가자에게 귀속되도록 하는 등의 기능을 해야 할
것이다. 따라서 착오로 인한 법률행위의 취소가능성 여부를 판단함에 있어서는 민법 제129
조에 규정된 취소요건을 기계적으로 따지는 것만으로는 부족하고, 관련 정보의 성격, 착오
를 일으킨 당사자의 계약상 위치, 착오위험의 인수 여부, 상대방의 착오유발 여부, 계약수
정이나 손해배상 등의 대체적 해결방법 유무 등의 다양한 요인을 고려하여야 할 것이다.
대법원 1989. 7. 25. 선고 88다카9364 판결의 경우 토지 경계가 정확히 어딘지는 피고가
원고보다 잘 알 수 있는 위치에 있었다고 할 수 있고, 더구나 한때 경계의 이쪽 토지와 저쪽
토지 모두의 소유자였던 피고의 그 동안의 행적은 원고로 하여금 실제의 경계에 대해 착오
를 일으키도록 유도한 측면이 있으므로, 원고에게 착오로 인한 의사표시를 취소할 수 있도
록 한 것은 타당한 것으로 보인다.A mistake is a belief that is not in accord with the facts. Rules governing when a contract is
voidable by a mistaken party affect the incentives of parties to acquire and disclose
information. Rules on mistake should desirably be designed to promote discovering of
productive information, to discourage investment in getting purely redistributive information,
to facilitate transmission of information uniting knowledge with control, and to make things
belong to the preferred party without incurring unnecessary transaction costs. In judging
whether to grant or reject excuse for mistake, therefore, one should take into account various
factors such as whether the information is productive or redistributive, whether the
information was acquired deliberately or casually, whether the mistaken party is seller or
buyer, whether the party was aware that he had only limited knowledge with respect to the
relevant facts but treated his limited knowledge as sufficient, whether the other party’s fault
caused mistake, and whether there is any relief by way of reformation, restitution, or others.
The Decision 88DaKa9364 by the Korean Supreme Court which granted the plaintiff's
rescission of an agreement for his mistake on a boundary line seems to be adequate, since the
defendant who had once been the owner of both lots on this and that sides of the boundary
was in a better position to know the true boundary and his behavior till the agreement might
have caused the plaintiff's mistake.
