집중적인 에너지 소비처로써 기후변화의 원인이 되고, 다양한 성장 동력을 보유한 도시는 녹색성장 정책에서 가장 중요한 분야 중 하나이다. 이 논문의 목적은 녹색도시 조성과 관련하여 그간 활발히 논의되지 못한 제도적 측면에서 현행 존재하는 법제도의 현황을 파악·분석하고 제도개선 방향을 도출하는 것이다. 연구 결과 자기 영역만을 규율하는 법제도, 분산되고 다기화된 주무관청, 계획요소별 개별법령 중심의 법제, 인센티브 제공 미흡, 지방의 자율적인 권한 미비 등이 주요한 문제점으로 도출되었다. 제도개선 방안으로는 저탄소 녹색성장기본법의 개정(녹색도시 추가), 국토계획법 중심의 녹색법제 통합, 개별법의 녹색성 강화, 녹색도시 조성의 실행력을 높이기 위한 인센티브의 확보 등을 제시하였다.Urban planning is one of the most important fields in green growth policies because citizens consume huge amount of energy and there are various dynamic forces for green growth in cities at the same time. Accordingly, this study does not only aim at analyzing current legal situation but also presenting alternatives in terms of institutional framework. The results show several problems: fragmented law and authorities, poor incentives, and inadequate sovereignty of local governments.
Several alternatives are suggested. The concept of ‘green urban planning’ should be included in the Green Growth Act. ‘A Greenness’ should be also integrated to National Land Planning Act and reinforced in each acts. In addition, national government needs to provide local governments and private entities with various incentives to enhance institutional feasibility. Therefore, it is necessary for national government to propose act amendments for green urban planning and provide local government with various types of incentives.
