미국의 1976년 저작권법 504조에 의하면, 저작권침해자는 저작권자의 실제 손해(actual damages)와 침해자가 얻은 이익(Profits) 또는 법정손해배상금(Statutory Damages)을 지급하여야 한다. 저작권자는 최종판결 전까지 언제든지 둘 중 하나를 선택하여 청구할 수 있다. 미국저작권법 제504조는 소송에서 우월한 원고에게 법에 따라서 등록요건을 충족하고 있는(17 U.S.C.§412) 경우에 실제손해 및 이익에 갈음하여 법정손해배상을 청구할 권리를 부여하고 있다. 법정손해배상은 저작권법에 특유한 제도이고, 특허, 상표, 영업비밀의 침해는 청구할 수 없다. 이처럼 실제손해액과 이익에 갈음하여 법정손해액(Statutory Damages)을 청구할 경우에는 저작물 1개에 관한 소송에 연관된 모든 침해행위로부터 침해자가 단독으로 책임을 지거나 2인 이상이 공동으로 혹은 각기 책임을 지는 행위에 대하여 750달러 이상 30,000달러 이하의 금액 중 법원이 정당하다고 인정하는 손해액을 배상받을 수 있다. 이 경우 편집저작물의 모든 부분들 또는 2차적 저작물은 하나의 저작물로 본다. 법원은 침해행위가 고의인 경우에 법정손해액을 150,000달러까지 인상할 수 있다. 침해자가 자신의 행위가 저작권 침해에 해당된다는 사실을 알지 못했고, 그 사실을 믿을 만한 정당한 이유를 가지고 있지 않을 경우에는 법원은 법정손해액을 200달러까지 감액할 수 있다. 침해행위의 태양이나 개수에 관계없이 등록저작물로써, 침해된 저작물의 개수를 기준으로 하여 법정손해배상액을 산정한다.
이에 대비하여, 우리는 한미FTA협정을 계기로 그 이행을 위한 2011년 제2차 개정 저작권법에서 미국 저작권법에서 규정한 법정손해배상제도를 도입하였다. 그 주요내용은, 첫째 실손해 입증의 어려움을 해소하기 위하여 저작물당 1천만원 이하, 영리목적으로 고의인 침해의 경우 5천만 원 이하의 법정손해배상 청구를 가능하게 하였고(법 제125조의2 제1항), 둘째 법정손해배상을 선택적으로 청구할 수 있는 시기를 사실심 변론종결시까지로 명확히 하였으며(법 제125조의2 제1항), 셋째 법정손해액을 청구하기 위한 요건으로 침해행위가 일어나기 전에 저작물 등이 등록되어 있을 것을 요구하고 있다(법제125조의2 제3항). 넷째, 둘 이상의 저작물을 소재로 하는 편집저작물과 2차적저작물은 제1항을 적용하는 경우에는 하나의 저작물로 본다(법 제125조의2 제2항). 마지막으로, 법정손해액을 산정함에 있어서도 법원은 변론의 취지와 증거조사의 결과를 고려하여 제1항의 범위내에서 상당한 손해액을 인정할 수 있다(법제125조의2 제4항). 종래 우리저작권법은 저작권침해를 원인으로 하는 손해배상액산정에 있어서 그 손해액산정의 어려움을 극복하기 위하여 제125조 내지 제126조의 특별규정을 두고 있었다. 그러나 이러한 규정들마저 제대로 효율적으로 기능하지 못하여 법정손해배상제도의 명문화를 위한 논쟁이 끊이지 않았다.
그러나, 새로 도입한 법정손해배상제도는 문제점도 없지 않아서 크게 다음과 같은 두가지 점의 개선책이 필요하다고 사료된다. 첫째, 저작권법상 법정손해배상액의 하한선을 정하지 않고 있다는 점이다. 둘째, 개정저작권법은 둘이상의 저작물을 소재로 하는 편집저작물과 2차적 저작물은 하나의 저작물로 본다(저작권법 제125조의2 제2항)고 규정하고 있는데, 그 판단기준에 관하여 문언해석에 충실하여야 하는지 아니면 합리적 해석을 할 수도 있는지 여부가 애매하다는 것이다. 이상과 같은 주요 문제점에 비추어 볼 때, 향후 입법적 개선책을 마련되기를 기대하고 싶고, 앞으로의 저작권법에 주어진 과제라 할 것이다.Section 504 of the U.S. Copyright Act of 1976 entitles a prevailing plaintiff, who complies with the Act’s registration requirements, to recover statutory damages instead of actual damages and profits. Under the revised copyright law, the first requirement for statutory damages is the infringed work should be registered. For most infringements, the court may award no less than $750 or more than $30,000(see 17 U.S.C. §504(c)(1)). The award can be reduced to $200 for innocent infringement(see 17 U.S.C. §504(c)(2)) per a copyrighted work or increased to $150,000 for willful infringement per a copyrighted work. Regardless of number of infringement, statutory damages should be calculated by the number of infringed work which is numbered by registration.
Article 125bis of Korean Copyright Act states that the infringed can select to seek actual damages or statutory damages when the actual damages caused by the infringer can hardly be proved and that the maximum of the statutory damages is 10 million Korean Won per a copyrighted work without its minimum. According to the said provision, its maximum can be raised to 50 million Korean Won per a copyrighted work when the infringement is willful and done for the infringer’s benefit. Before the revised copyright law, for avoiding difficulties of damages calculations of copyright infringement, Article 125 &126 of Korean Copyright Act prepared some special provisions.
But, due to the fact that such provisions would not function effectively, there have been consistent debates on making a stipulation of the Statutory Damages to make up the copyright owner’s actual damages and any additional profits of the infringer.
Finally, the current statutory damages in copyright law recently came in through the Korea-U.S Free Trade Agreement(the KORUS FTA) left room for various improvements and need to amend statutory damages in several points in the future. So, this article will proposes how the Korean legal system adopts properly the Amerian-styled statutory damages from now on. Consequently, first, we need to have ground rules for the Statutory Minima in computing Statutory Damages. Second, it is needed to have a proper standard of judgment whether each constituent element of a compilation or collective work to be treated as a separate work for the purposes of statutory damages.
