집단표시의 문제는 명예훼손 소송에 있어 지속적인 논란을 불러일으키고 있는문제이다. 그럼에도 불구하고 국내에는 이에 대한 판결 기준 등 선행연구가 미흡한 상황이다. 이에 본 연구는 집단표시 문제에 관한 판례분석을 통해 이 문제에대한 법원의 인식을 도출하고, 명예훼손 소송에 있어 집단표시와 피해자 특정 문제를 합리적으로 가늠할 수 있는 판결의 기준을 탐색적으로 제시하고자 하였다.
구체적으로 집단표시에 의해 명예훼손이 성립된 23개 사건 34개 판례에 대한 분석을 수행하였다.
분석결과 첫째, 명예훼손 소송을 제기한 원고가 승소한 판례는 14개 사건 20개판례, 패소한 판례는 9개 사건 14개 판례였다. 둘째, 집단표시 관련 판례에 나타난 명예훼손적 표현을 구성하는 집단의 크기 대체로 8∼49명 수준인 것으로 나타났다. 예외적으로 295명의 여성 아나운서, 13,564명의 4.3사건 유족에 대한 집단표시가 명예훼손에 해당한다는 판례도 존재했다. 다만, 295명의 여성 아나운서, 13,546명의 4.3사건 유족에 대한 집단표시는 명예훼손적 표현이 아니라는 판례도 동시에 나타났다. 또한 140∼4,000명 수준의 집단표시는 일반적으로 피해자 특정이 어렵다는 판례가 도출되었다. 셋째, 표현주체가 언론일 경우 공익성이인정될 경우 위법성 조각사유로 인정받을 가능성이 있는 것으로 나타났다. 넷째, 원고의 지위에 따른 소송 결과를 확인한 결과 대부분의 집단표현 관련 소송(15개사건 27개 판례)은 공인에 의해 제기되었다. 다섯째, 피고의 지위에 따른 소송 결과를 확인한 결과 집단표시 관련 소송은 포괄적 의미의 언론사의 보도가 명예훼손 소송으로 비화된 사건이 19건(55.88%)으로 가장 많았다. 본 연구는 이상의 연구결과를 바탕으로 집단표시 관련 소송 발생시 예측가능한 판결을 이끌어 내기 위한 제언, 언론의 공인에 대한 집단표시 관련 표현시 언론의 자유를 보호하기 위한 제언을 수행하였다.This study set out to examine the court's perceptions of the group defamation issue and make an exploratory proposal of the judgment criteria to assess group defamation and victim specificity issues rationally in libel suits by analyzing the precedents (23 cases, 34 precedents) regarding the group defamation issue.
The analysis results were as follows: first, there were 14 cases and 20 precedents in which the plaintiffs that filed a libel suit won, and there were nine cases and 14 precedents in which they lost. Second, the group size that constituted a libel expression was approximately 8∼49 people in the precedents related to group defamation. Third, when the subject of expression was the media and its public interest was recognized, there was a possibility of recognition as a circumstance precluding wrongfulness. Fourth, the study checked the results of suits according to plaintiff status and found that most of the group defamation-related suits were filed by public figures. Finally, the study also checked the results of suits according to defendant status and found that the cases were greatest at 19 (55.88%) in which the reports of the media in a comprehensive sense escalated into a libel suit among the group defamation-related suits. Based on those findings, the study made proposals to help the media protect freedom of speech when making group defamation-related expressions for public figures.
