하구(河口, estuary)는 그 물리적・화학적 특성으로 인해 다른 어느 생태계보다도 다양하고 동태적이며 독특한 생태환경을 조성한다. 그로 인해 하구는 현존 지구생태계 중 단위면적 당 생태적 가치가 가장 크다고 분석되는 등 환경적・생태적 측면뿐만 아니라 사회・경제・문화 등 다양한 측면에서 매우 높은 보존가치로 인해 주목받고 있는 수역이다. 그럼에도 불구하고, 우리나라 하구는 그동안 무분별한 개발・이용 위주의 하구정책의 시행, 하굿둑 등 각종 인공구조물의 설치 등으로 인해 하구 환경과 생태계는 회복이 거의 불가능할 정도로 심각하게 파괴・훼손되어 하구 본래의 고유한 특성과 기능을 거의 상실한 채 여전히 다양한 개발압력에 처해있는 것으로 지적되어 왔다. 이는 이미 이전부터 하구의 환경적・생태적 보존가치와 중요성을 인식하여 하구환경을 종합적이고 체계적으로 보호・개선 및 복원하기 위한 다양한 기술과 국가정책프로그램을 개발・시행하고, 관계법령을 정비해온 하구관리 선진 외국의 사례와도 크게 대비되고 있다.
이에, 우리나라에서도 근래 들어 하구의 환경적・생태적 보존가치에 주목하여 과학기술적인 측면뿐만 아니라, 법적・제도적 측면에서 하구의 종합적이고 체계적인 복원・관리시스템 개발을 위한 다수의 연구가 수행되고 있다. 현재 해양수산부 한국해양과학기술진흥원(KIMST)의 해양환경기술개발사업의 일환으로 2014~2018년에 걸쳐 5년 간 진행되고 있는 「하구역 종합관리시스템 개발연구(Ⅱ) - 금강하구역을 대상으로 -」도 그러한 주요 연구사업의 하나이다. 또한 최근에는 하구의 복원・관리에 관한 특별법안 2건(「박완주의원 대표발의 특별법안」 및 「최인호의원 대표발의 특별법안」)이 국회에 각각 제출되어 제정에 관한 논의가 진행 중이다. 특히 해양수산부의 연구사업은 금강하구역을 대상으로 관련 조사・연구・모니터링시스템, 모델링시스템, 평가시스템, 정보시스템 및 이해당사자 간 논의구조 개발 및 관련 법제도 정비・개선을 위한 연구작업을 수행하고 있으며, 하구역 종합관리시스템을 개발・구축하는 등 그동안의 연구성과를 체계적으로 축적하여 공개하고 있다.
이러한 상황에서, 본 논문은 그동안의 여러 연구성과들을 종합하고, 그러한 연구성과들이 실제로 법적・제도적 기반으로 성숙되기 위한 법제화 지원방안을 마련할 것을 주요 목적으로 하였다. 이룰 위하여 본 논문은, 하구역 종합관리시스템 개발・운영을 위한 법제화 과정에서 특히 중점적으로 논의되고 고려되어야 할 주요 사안으로서, ① 종합관리 대상으로서 하구(역)의 법적 정의 및 적용범위(Ⅱ), ② 하구(역)환경의 종합관리 정책목적 및 조치유형의 체계성・통합성(Ⅲ), ③ 하구(역)환경의 효율적인 종합관리를 위한 책임체계와 의사결정체계(Ⅳ), ④ 하구(역)역환경의 종합관리 사업의 체계적인 시행 메커니즘(Ⅴ)을 중심으로, 주요 쟁점과 문제점, 국내외 입법・정책 사례 등을 검토・분석하고, 실제 법제화를 위해 법정책적 관점에서 각 주요 사안별로 고려 및 반영되어야 할 사항들을 종합적으로 정리 제시하였다(Ⅵ). 이를 통해 향후 하구역 종합관리시스템 개발・운영을 위한 법제화 작업에 적절히 기여할 수 있기를 기대한다.Estuaries, forming a dynamic and unique ecological environment due to its physical, chemical and biological features, have been considered to have the highest ecological value in the earth’s ecosystems per unit area. Its utility value of social, economic and cultural aspects as well as its conservation values of ecological aspects has attracted public attention. Despite its acclaimed utility, estuarine environment and ecosystems in Korea have been severely destroyed almost beyond restoration as a result of ill-considered development/use-oriented estuarine policies, installation of various artificial structures including estuary bank, etc. Consequently, majority of large scale estuaries in Korea have almost completely lost their inherent nature and functions, all the while still facing heavy pressure for development and use. Meanwhile, several developed countries, including the U.S., UK, etc., have established estuary management system and implemented laws and integrated management programs concerning protection/conservation, improvement and restoration of estuarine environment.
In this respect Korea has recently been implementing a research and development (R&D) project titled 「Development of Integrated Estuarine Management System」, funded by the Ministry of Oceans and Fisheries, Korea, to develop an integrated and systematic regime for restoration and management of estuaries in not only legal and institutional, but also scientific and technical aspects. In addition, two special bills for the restoration and management of estuaries have been submitted to the National Assembly of the Republic of Korea for legislation discussion. The on-going research project and proposed bills have been regarded as normative approaches to establish an integrated estuarine management system in Korea.
This article aims to combine the conclusions from various research projects, leading the National Assembly to develop a legal and institutional basis to support legislation for the integrated estuarine management system. In order to achieve this goal, this study addresses and analyzes major issues to be discussed during legislation for the 「Development of Integrated Estuarine Management System」, which are as follows:
① a legal definition and application scope of an estuary and estuarine zone as a management object,
② systematic organization and integration of policy objectives and methods for the management of estuarine environment,
③ liability and decision making systems for the comprehensive and effective management of estuarine environment, and
④ a systematic implementation mechanism for the integrated management activities of estuarine environment.
Through such discussions and analyses, the article suggests and identifies major considerations for the legislation of 「Development of Integrated Estuarine Management System」 from a legal policy perspective.
