헌법재판소는 2016. 10. 27. 2014헌마797 사건에서 지방자치단체장 선거권은 헌법상 인정되는 기본권이라고 판시하였다. 이는 지방자치단체장 선거권과 피선거권은 법률상 권리에 불과하다고 본 종전의 결정(2007년 및 2014년)을 뒤집은 것이다.
위 결정의 주요 논거는 다음과 같다. 지방자치단체장이 주민직선에 의하여 선출되는 관행과 이에 대한 국민적 합의가 안착한 현 시점에서는 헌법 제24조의 선거권을 헌법상의 선거권과 법률상의 선거권으로 분리할 수도 없고, 주민 직선에 의하여 선출되는 지방자치단체장은 지방자치제도의 본질적 내용이 되었다고 한다.
그러나 공직선거법 제1조 등이 명문으로 헌법에 의한 선거와 지방자치법(률)에 의한 선거를 구별하고 있고, 역대 헌법에서도 현행 헌법과 동일한 조항을 두고 있었음에도 법률적 차원에서 지방자치단체장의 선임방법으로 임명제나 지방의회에 의한 간선제를 채택하기도 하였기 때문에 헌법재판소의 위와 같은 논거는 설득력이 거의 없다.
또한 지방자치제도의 본질적 내용 중의 하나로 지방자치단체장을 주민직선에 의하여 선출하는 것을 든 것은 지방자치단체장의 ‘선임방법’을 ‘주민직선제’로 환치시킨 것이다. 이는 헌법해석의 문의적 한계를 벗어난 것이고, 지방자치단체장 선출에 관한 사항을 입법자에게 위임한 주권자(헌법제정권자)의 의사에 반하는 것이다.
마지막으로 이 사건 결정의 기저에 흐르는, 즉 위 두 논거의 전제가 되는 논거는 지방자치단체장 선거권이 관습헌법화 되었다는 것이다. 그러나 위와 같이 2년 혹은 길게 잡아도 9년 밖에 안 되는 기간에 헌법적인 관행이 자리잡을 수도 없고, 필자와 같이 법률상의 권리에 불과하다는 견해도 상당한데 국민적 합의는 어떻게 확인하였는지 알 수도 없다. 무엇보다 관습헌법의 개념을 인정할 수 없고, 가사 인정한다고 하더라도 지방자치단체장 선거는 헌법상 핵심적이고도 기본적인 사항이 될 수 없다. 헌법재판소가 국민의 정치적 의사에 맡겨도 될 사항에 굳이 개입한 것은 조잡한 사법적극주의에 다름 아니다.Constitutional Court ruled that right to elect the head of the local government should be a fundamental right under the Constitution in the case ‘2016.10.27. 2014Hun-Ma797’ which was about ‘the mutatis mutandis application from local assembly election to the head of a local government election’ clause(Public Official Election Act §191③, 188②). This decision turned its own previous ones which had ruled that the right to elect the head of the local government was no more than a legislative right.
The principal reasonings in this case were the following: (ⅰ) the head of the local government has been elected by the direct election of the local constituency, and such practice has got the wide national consensus, and this practice has come to be constitutional custom. (ⅱ) right to vote under the Constitution §24 cannot and shall not be invisible, so the right to elect the head of the local government has come to the same right with the right to elect President, member of National Assembly, member of Local Assembly. (ⅲ) In light of the above said constitutional custom, the right to elect the head of the local government shall be included the essential aspect of local autonomy.
But above-said decision of the Constitutional Court deserves the following critique. (ⅰ) The concept of constitutional custom cannot be accepted generally. And if accepted, such short term(2∼9 year) is not enough to be admitted to constitutional custom. Above all, things about the right to elect the head of the local government is not constitutionally basic and essential matters. (ⅱ) above second reasoning does not match the system of the successive constitution. Previous constitution and the current Public Official Election Act divide the elections prescribed by the Constitution into the election prescribed by the Local Autonomy Act. (ⅲ) What the Constitutional Court interpreted the ‘election precedure’ of the head of the local government as the direct election by the local constituency transgress the limitation of the meaning of a passage.
