본 연구는 의료분야의 비영리법인 사례분석을 통해 주무관청의 과잉감독의 실태를 분석하여 앞으로 주무관청의 감독의 적절성을 탐색적으로 평가하고자 하였다. 이를 바탕으로 비영리법인에 대한 바람직한 정부기관의 감독 방안을 제시하고자 하였다. 이를 위해 의료관련 법인인 A법인을 대상으로 주무관청의 감독실태를 사례분석하였다. 사례분석의 결과를 바탕으로 다음과 같은 정책적 함의가 제시되었다. 첫째, 주무관청의 감독이 사람이 아니라 원칙에 의해 충실히 이행될 수 있도록 해야 한다. 둘째, 의료분야의 경우 높은 전문성 수준을 감안하여 동료평가(peer review)식의 감독방식이 보충되어야 하며, 주무관청의 담당자들의 역량과 전문성을 향상시키는 교육훈련이 강화될 필요가 있다. 그리고 인수인계과정의 명확하게 제도화되어 감독업무의 연속성을 높일 필요가 있다. 셋째, 전통적인 명령지시적 규제방식에서 정부와 피규제자, 그리고 이해당사자들이 협업을 하는 규제거버넌스 체제를 모색할 필요가 있다. 넷째, 의료법인, 학교법인, 비영리법인 등으로 분산되어 있는 현재 의료분야 감독체계를 합리화할 필요가 있다. 이때 “동일 행위에 대해 동일 감독”이라는 공정성 원칙이 확보되어야 한다. 다섯째, 의료분야의 비영리법인도 보다 많은 자율성을 주장하려면, 단기적인 수익성 외에도 장기적인 평판 관리, 즉 기업의 사회적 공헌(CSR) 활동이 강화될 필요가 있다.This study aims to identify the practices of the government over-supervision, make an exploratory evaluation of its appropriateness, and try to suggest more desirable ways of government supervision. To do this, it selected A corporation in the medical area as case organization and did case analysis of the practices of government supervision there. Based on the results of case analysis, it suggests some policy implications as follows. First, government supervision should be made by the faithful compliance with the principles, not by human discretion. Second, in case of medical area which requires high professional expertise, the supervision should be supplemented with peer reviews, and the education and training be extended to improve the capacity and expertise of government employees involved in supervisory work. It is necessary to maintain the consistency in supervision by explicitly institutionalizing the process of its work transfer to the successor. Third, it is recommended to seek for building regulation governance on the collaborations among government, the regulated and other stakeholders, beyond traditional and instructional regulation. Fourth, it is also necessary to reform the supervision structure in the medical area, which is currently distributed among medical, educational, and non-profit corporations. And it is suggested to adopt such a principle of fairness as “equal supervision over equal work.” Fifth, non-profit organization in the medical area needs to extend the activities of corporate social responsibility (CSR), for long-term image management in addition to short-term profit seeking, in order to request the extension of its own autonomy.
