본 논문은 북한 부동산거래법의 변모와 향후 추이를 예측하고, 남북한의 접근가능성과 한계를 규명하고 있다. 종래 북한의 민법이론은 ‘부동산’을 별도의 법률용어로 사용하지 않았으나, 1990년 민법(94조)을 제정하면서 ‘부동산’과 ‘부동산거래’를 법률용어로서 명시하였다. 그러나 북한은 여전히 민법(148조, 179조)과 부동산관리법(28조 6호, 30조)에서는 현실과 달리 부동산을 대상으로 한 매매 · 임대차 등의 거래를 금지하고 있다. 여기서 북한 민법(94조)의 ‘부동산거래’의 내용에 대해서는 밝히고 있지 않으나, 이는 부동산을 매개로 하는 채권계약과 물권적 합의로 파악할 수 있다. 또한 북한은 특수지대와 외국인에게 토지임대법, 개성공업지구 부동산규정, 부동산규정 등에서 중국 법제를 계수하여 매매 · 교환 · 임대 · 저당 등의 부동산거래를 인정하고 있다. 북한 부동산거래법의 향후 추이를 예측해 보면, 민법에서는 주택에 대해 사용대차를 제한적으로 인정할 가능성이 엿보이며, 매매 · 교환도 점진적 변화가 이루어질 것으로 전망된다. 또한 그 밖의 실질적 민법에서 남북경협의 재개와 함께 개성공업지구 부동산규정의 활성화와 더불어 특수지대에서 개성공업지구 부동산규정의 부동산거래법으로서의 비중 강화, 토지이용권에 대한 현재 중국 부동산거래법제의 계수가능성 등이 예측된다. 여기서 남북한 부동산거래법은 부동산과 매매 · 임대 · 저당 등의 정의, 저당권이 효력이 미치는 범위, 물상대위 등의 규정들이 우리 민법과 유사하며, 이는 남북한 민법의 접근가능성이 보다 제고되는 것으로 생각된다. 끝으로 남북한 부동산거래법을 둘러싼 민사법제의 통합을 모색함에 있어서는, 자유민주적 기본질서와 사적 자치를 전제로 해야 된다는 점에서 이에 배치되는 규정 등은 모두 폐기되어야 할 것이다.This paper examines the change of North Korea’s real estate contract laws, predicts their future transition, and considers the possibility and limitation of mutual approach in real estate contract laws between South and North Koreas. North Korea used to not use the legal term of ‘real estate’ previously, but set forth ‘real estate’ and ‘real estate contracts’ as legal terms when instituting the 1990 Civil Act (Article 94). As opposed to reality, however, the Civil Act (Articles 148 and 179) and Real Estate Control Act (Article 28(6) and Article 30) of North Korea still prohibit the contracts of real estate, including sale and lease. The Civil Act (Article 94) of North Korea does not specifiy the specific contents of ‘real estate contracts,’ but they may be understood as claim contracts by the media of real estate and agreements on real right. On the other hand, North Korea received the legal system of China, and allows real estate contracts such as sale, exchange, lease, and mortgage in special zones and to foreigners in accordance with the Land Lease Act, RERKIZ (Real Estate Regulations for Kaesong Industrial Zone), and real estate regulations. To predict the future transition of North Korea’s real estate contract laws, the civil act shows the possibility of restrictively granting the loan for use of housing, and it is forecast that sale and the contract of exchange will be gradually accepted. In addition, it is expected that RERKIZ will be revitalized according to the reopening of South-North economic cooperation and be enhanced as a real estate contract law in special zones, and that the current system of China’s real estate contract laws will possibly be received with respect to land usufruct.
