IT 기술의 발달과 스마트폰의 대중화는 지금까지 여겨왔던 방송의 개념을 변화시키고 있다. 특히 시대적 화두인 유튜브, 넷플릭스, 아프리카TV와 같은 동영상 플랫폼은 외견상 기존에 방송과 유사하면서도 실제로는 매우 개방적이고 누구에게나 이용이 자유로운 인터넷에 기반을 두고 있다. 그 중에서도 1인 미디어의 등장은 이용자들로 하여금 다양한 콘텐츠를 향유할 수 있게 하였지만, 이를 규제하는 방식이 기존의 방송보다 비교적 느슨하여 규제 역차별이 발생하고 있다는 의견이 제기되고 있다. 1인 미디어는 인터넷상의 정보로서 비교적 엄격한 방송법 대신 정보통신망법을 적용받기 때문에 콘텐츠의 내용이나 표현 방식이 비교적 자유롭다. 따라서 이러한 이점을 살린 1인 미디어는 보다 다양한 이용자들의 수요에 대응할 수 있다는 유리한 입장이라고 볼 수 있다. 1인 미디어는 새로운 정보를 알리거나 또는 대중에게 잊혀져있던 중요한 정보를 다시 환기시킴으로서 사회적 논의로 이어지게 하는 긍정적 측면이 있다. 반면 장난삼아 혹은 타인 또는 특정 집단을 비방하려는 목적의 가짜뉴스와 같은 콘텐츠는 1인 미디어가 지니는 긍정적 측면을 훼손시키고 있다는 의견도 존재한다. 인터넷 고유의 특성상 한 번 이슈가 되는 사안은 일파만파로 걷잡을 수 없이 퍼지고, 그 결과 예상되는 사회적 혼란이나 피해는 상당하다. 하지만 이를 규제의 대상으로 하기 위해서는 가짜뉴스가 무엇인지 적용 대상을 분명이 할 필요가 있고, 필요시 국내뿐만 아니라 국외에서도 규제가 가능한지 검토가 필요하다. 그리고 수많은 콘텐츠를 일일이 확인하고 심사하여 삭제하는 일도 쉽지 않다. 인터넷은 자유로운 공간이다. 인터넷이라는 환경은 정보가 끊임없이 쏟아져 나오고 이를 수정 요청하거나 반박하는 의견을 실시간으로 제기할 수 있다. 이용자들은 자기 나름대로의 판단과 ‘강제’가 아닌 ‘선택’에 따라 1인 미디어의 뉴스를 구독하거나 시청하고 있다. 따라서 눈앞에 예상되는 피해가 중대하거나 명백한 경우가 아니라면 규제나 관련 법률을 확대하여 인터넷이라는 공간을 제한하는 방식보다는 인터넷 본연의 특성인 이용자 간의 교차검증 활성화, 플랫폼 사업자의 자율 규제 및 인터넷 리터러시 교육 등이 제안된다.The development of IT technology and the popularization of smartphones are changing the concept of broadcasting today. Currently, online video platforms such as YouTube, Netflix and Africa TV are becoming a hot issue. Although it looks similar to broadcasting, but it is actually based on the Internet which is very open and free to everyone. The emergence of personal media has allowed users to enjoy various contents, yet the idea of regulatory discrimination between personal media and broadcasting has been consistently raised. Because personal media is considered information on the Internet, it is subject to the Act on the Internet instead of Broadcasting Act. Thus the contents and expressions of personal media relatively have more latitude. Consequently the internet based personal media can be considered as an advantageous situation to respond to the interests of various users. Personal media has the positive side of raising social discussions by giving new information or reminding faded social issues. On the other hand, there is a different view that content including fake news aimed at slandering others or certain groups is undermining the positive side of it. Due to the unique nature of the Internet, the spread of information is very fast and not easy to control. Ultimately, the expected social confusions or damages are substantial. But before the regulation is considered and designed, it needs to clarify the definition of fake news, and it should also have a fair condition of regulations that can be applied not only at domestic, but also equally at the abroad. Indeed, it is not easy to screen and delete all of contents. The Internet is opened for everyone. The internet users can raise opinions in real time about constantly influx information and correct or refute it. The users can subscribe or watch news from personal media based on own decision and "choice" rather than "compulsion." Therefore, unless the expected damage is very serious or obvious, activate cross-checking among users, self-regulation of platform operators, and education of Internet literacy can be the options, rather than by expanding regulations or legislating law to limit the personal media and the internet.
