현대 민주주의는 정당제 민주주의라고 할 만큼 정당이 정치과정에서 행하는 역할이 중요하다. 민주주의가 제대로 작동하려면 정치과정의 핵심적 주체인 정당의 활동이 민주적이어야 한다. 이 정당활동의 가장 중요한 부분이 각종 공직선거후보자를 공천하는 행위이다. 공천이 민주적으로 이루어져야 정당이 민주화되고 정당이 민주적이어야 민주주의 정치가 발전하는 것이라고 할 수 있다.
2002년 지방선거와 대통령선거를 앞두고 국민참여경선이라는 민주적 상향식 공천제가 도입되었고, 2005년에는 선거관계법에 당내경선제가 규정되어 우리나라 정당의 공천관행에 획기적인 변화를 가져오게 되었다. 그러나 2008년 국회의원선거에서부터 경선제 공천방식이 후퇴하기 시작하여 당지도부의 영향력에 좌우되는 과거의 공천관행으로 되돌아가고 있는 것같이 보인다. 비례대표제의 확대가 예상되는 가운데 민주적 공천제가 확립되지 않으면 국회의 선진화 민주화는 오히려 후퇴할 것이 분명하다.
현재 선거법은 공천을 민주적 절차에 따라야 한다고만 규정하고 그 자세한 사항은 당헌・당규에 위임하고 있다. 정당들은 당헌・당규에서 공천절차를 경선을 원칙으로 규정하고 있지만 다양한 예외를 인정함으로써 실제 공천과정은 비민주적 형태로 실시되고 있는 실정이다.
이 글에서는 헌법의 요청에 따라 선거법을 다음과 같이 개정할 것을 제안하였다.
첫째, 공천은 평당원의 참여와 비밀투표가 보장되는 민주적 경선으로만 하여야 한다. 그리고 민주적 경선절차 이행 증명을 선거관리위원회에 보고하게 하고 그 보고서가 법 소정의 요건에 부합하지 없을 때에는 선관위가 해당 입후보자의 입후보 신청을 거부할 수 있도록 하여야 한다.
둘째, 비례대표후보자 공천절차도 지역구후보자와 마찬가지로 반드시 민주적 경선절차에 따라야 함을 선거법에 명시하여야 한다.
셋째, 선거관리위원회 제안처럼 국민참여경선(open primary)을 할 수 있는 근거를 선거법에 규정하는 것이 바람직하다.As modern democracy is called party democracy, the role of political parties in the political process is important. In order for democracy to function properly, the activities of political parties, the core actors of the political process, must be democratic. The most important part of this political activity is the nomination of candidates for public office. Democratic politics can only be developed when nominations are democratically, and parties must be democratized.
In 2002, ahead of local elections and presidential elections, a democratic bottom-up nomination system called the People Participatory Primary Election was introduced. However, starting with the 2008 parliamentary elections, the nomination system seems to be retreating back to past nominal practices that depend on the influence of the party leadership. If the proportional representation system is expected to expand, and democratic nomination is not established, it is clear that the advanced democratization of parliament will retreat.
The current election law only requires that nominations be followed by democratic procedures, and details are delegated to party constitutions and party regulations. Although the party constitution and party regulations prescribe the nomination process as a principle, at the same time they acknowledge various exceptions, so the actual nomination process is carried out undemocratically.
This article, at the request of the Constitution, proposes to amend the election law as follows:
First, nominations should be made only in democratic contests with guaranteed participation of common party members and secret ballots. Proof of the implementation of democratic primary proceedings shall be reported to the Election Commission, and if the report does not meet the requirements of the law, the Election Commission shall refuse to accept the candidate.
Second, the election law must specify that the nomination process for proportional representative candidates must follow the democratic primary procedure, just like regional candidates.
Third, it is desirable to define the grounds for open primary elections in the electoral law, as suggested by the Election Commission.
