이 연구는 지방의회와 관련한 세 가지 연결된 질문을 제기한다. 첫째, 지방의회는 잇단 실패에도 왜 의회 지원조직의 확충 혹은 독립적 입법지원기구의 설치를 계속해서 시도하는가? 둘째, 지방의회가 자치단체장에서 독립된 사무조직 혹은 지원조직을 갖추는데 어려움을 겪는 법·제도적 문제는 무엇인가? 셋째, 국회에 이를 위한 근거 조항을 담은 법안들이 계속해서 발의됨에도, 본회의의 문턱을 넘지 못하는 이유는 무엇인가? 본 연구는 서울시의회의 자료와 20대 국회의 법안 분석을 통해 하나의 답을 찾는 노력이다.
본 연구의 주장은 다음과 같다. 첫째, 지방의원의 보좌 인력 충원이나 독자적 지원조직에 대한 요구는 의회가 제도화면서 업무량이 증가하고 기능이 세분화·전문화되는 상황에 기인한다. 둘째, 현재의 「지방자치법」은 지방의회의 고유 기능을 행정부령에 과다하게 위임하고 있으며, 이는 지방정부의 권한을 크게 제약한다. 지방의회와 단체장은 헌법상 동등한 지위를 가짐에도, 「지방자치법」은 단체장이 지자체를 대표하게 하고, 의회의 직원 임면권과 조직권을 부여한다. 이는 두 기관의 관계를 종속적 관계로 왜곡한다. 셋째, 지방의회에 인사조직권을 부여하거나, 독립된 지원기관을 설립할 수 있는 법적 근거를 마련하려는 여러 입법 시도가 있으나, 대부분 상임위 문턱을 넘지 못했다. 본 연구는 20대 국회의 사례 분석을 통해 세 가지 이유를 제시한다. 「지방자치법」은 그 내적 속성상 다른 법안에 비해 제·개정이 어렵다. 지방자치법은 다양한 이해의 충돌을 전제하며, 그 개정의 영향은 전국적이다. 법안의 심의과정에 중앙정부의 강한 반대가 제기되었고, 이는 의원에 부담으로 작용한다. 또한, 19대 국회에서 유사한 법안이 법사위에서 부결된 사례가 있었던 것도 일종의 전범(典範)으로 작용한다.This study begins with three questions related to local councils. First, why does the local councils continue to attempt to establish independent legislative support organizations? Second, what are the legal obstacles that make it difficult for local councils to establish an independent supporting organization under its local councils? Third, even though legislation containing provisions for legislative supporting organizations is continuously proposed to the National Assembly, why does it fail to become laws?
This study provides answers to the questions through a careful review of the Seoul Metropolitan Council’s effort, laws, and previous legislation process related to this issue. First, despite criticism about local legislators’ demand for recruitment of personal staff, this study argues that it is a situation requiring specialized supporting personnel in accordance with the workload increase and establish itself as a’ law-making’ council. Second, examining the relevant provisions of the current local autonomy law and related government acts that have been a stumbling block to the local council’s successive attempts, this study claims that the inconsistencies of the laws have frustrated the establishment of an independent council supporting body. Third, the local council needed a legal basis to establish a separate supporting organization, but failed to create it. Although several bills were proposed in the 20th National Assembly, they were not even introduced to the plenary session. It is because of the central government’s opposition and a precedent in which the Judicial Council rejected the same bill in the 19th National Assembly. Also, this study points out that since the local autonomy law itself has a variety of interests and conflicts, the passage of amendments was not easy to pass in the national assembly compared to other laws.
