GAFA 등의 디지털플랫폼은 개인데이터 등을 축적함으로써 디지털플랫폼을 이용하는 사업자에게 큰 영향력을 미칠 수 있게 되었다. 디지털플랫폼과 이용사업자 사이의 거래를 투명화하는 방안이 문제된다.
이 점에 관해 EU에서는 디지털플랫폼의 거래를 투명화하기 위한 규칙이 제정·공포되어 2020년 7월부터 효력이 발생하고 있다. 규칙은 상품·서비스를 중개하는 온라인중개서비스 기업과 웹 페이지를 검색하는 온라인 검색엔진 기업을 그 규제대상으로 하고 있다.
규칙에서는 온라인 중개서비스 기업에 대해 이용사업자와의 사이에서 체결하는 계약에 일정한 조항을 정해야 할 것이나 중개서비스를 정지·해제하는 경우에 소정의 절차를 거쳐야 할 것, 또한 수집되는 개인데이터 등을 이용할 수 있는 자나 그 범위·조건 등을 명확히 해야 할 것 등이 요구되고 있다.
또, 온라인 중개서비스 기업과 온라인 검색엔진 기업 공통의 규율로서 순위(ranking)이 어떠한 변수(parameters)에 근거해 산출되고 있는지를 명확히 할 것, 또 온라인 중개서비스 기업 등이 자신이 제공하는 상품·서비스와 다른 사업자·웹 개설자가 제공하는 상품·서비스를 차별적으로 취급하는 경우에는 그 취지와 근거를 나타낼 것이 요구되고 있다.
EU의 규칙은 우리나라에서의 입법 작업 및 공정거래법의 적용에 있어서 참고가 된다. 우리나라에서도 이노베이션을 저해하지 않는 한편 공정한 거래를 촉진하기 위해 디지털 사회의 법적인 인프라로서 디지털플랫폼 관련 규율이 필요하다고 할 것이다.Digital platforms such as GAFA can have a great influence on companies that use the digital platform by accumulating personal data. The question is how to ensure transparency in the transaction relationship between the digital platform and the operators using the platform.
In this regard, the EU has enacted and promulgated regulations to make transactions of digital platforms more transparent, and they have been in effect since July 2020. The EU Digital Platform Regulation targets online intermediary service companies that mediate goods and services and online search engine companies that search web pages.
The regulations require online intermediary service companies to establish certain provisions in contracts concluded with users, to go through prescribed procedures when suspending or terminating intermediary services, and to clarify who can use the collected personal data, its scope and conditions. In addition, it is required to clarify the variables based on which ranking is calculated as a common discipline between online intermediary service companies and online search engine companies. EU rules are helpful in the application of legislation and the Fair Trade Act in Korea. In order to promote fair trade without hindering innovation, Korea also needs discipline related to digital platforms as a legal infrastructure for the digital society.
