우리 사회가 스토킹에 대한 심각성을 인식하고 논의를 시작한지 상당한 시간이 흘렀지만 2021년 현 시점까지 입법에 실패해 왔다.
법무부는 2020. 11. 27. 법안을 입법예고하였고 이 입법안은 2020. 12. 29. 국무회의를 통과하여 향후 논의 과정에서 가장 중요한 대안이 될 것이다.
법무부의 입법안은 스토킹을 범죄로 규정하여 처벌규정을 둔 점에서 이전의 입법안들과 유사하나 새롭게 응급조치 및 잠정조치를 도입하였다. 이러한 조치들은 2019년 발의하였던 내용과도 크게 달라졌는데 관할 경찰서장이 판사의 승인을 받아 응급조치를 할 수 있다는 점이 그 것이다.
이러한 응급조치는 경찰행정법적인 조치라고 할 수 있고 법무부의 입법안은 스토킹에 대한 핵심적 대응으로 경찰행정법적인 조치를 채택한 것으로 평가할 수 있다. 이는 향후 유사법제에도 큰 영향을 미칠 수 있는 획기적인 변화이다.
본고는 법무부 입법안의 각종 조치를 가정폭력처벌법상의 조치들과 비교하였고 더 나아가 스토킹에 있어서 형사처벌이 가지는 실효성을 다른 나라의 상황을 참고하여 검토하였다. 독일과 일본의 처벌규정은 법무부 발의안과 유사하기에 그 운용상황이 크게 참고가 될 것이다.
Features of stalking crime is that most of the victims are women, the occurrence of stalking often happens by the acquaintances of the victims and the situation gets worse as time passes. Therefore, in order to protect the victim of the stalking, an effective countermeasure is needed.
Since the current law has limitations in penalizing the act of stalking, establishing a special law may be established for the protection of victim may be considered. The current Stalking punishment bills which is currently pending in the National Assembly, is not much different from the laws that have been submitted in the past. However the ministry of justice has issued a new bill.
In this study, I examined the problems of the incumbent legislation on stalking, and explored effective ways to protect victim. Legislative situations of each country reflect the unique attributes of the people of the country, such as the judiciary, legal reality, and criminal policy needs. Therefore, it is not desirable that the legislative situation of a certain country is directly reflected in Korea. However, it is not possible to deny that there is a corresponding reason when many countries deal with some crime and social phenomena with common interest.
Because the law is limited to the initial response to stalking punishment, the necessity of a special law has been raised. I hope that stalking bill go through the parliament which enables the country to actively intervene stalking crimes in the future.
