지구상의 자원의 고갈 그리고 환경오염의 문제가 대두되는 시점에서, 우주에 있는 자원을 활용해보고자 하는 구상이 최근에 대두되고 있다. 현재의 기술로서는 대규모 자원채취를 경제성 있게 실현하는 것이 불가능하지만, 추후 기술 발전에 따라 이는 또 하나의 경제적 게임체인저(game-changer)로 대두될 가능성도 배제할 수 없다.
이러한 우주자원의 탐사, 채취, 이용을 국제법적으로 규율할 필요성은 미국이 ‘상업우주발사경쟁력법(Commercial Launch Competitiveness Act)’을 제정하면서 본격화되었다. 동법의 제4편인 ‘우주자원의 탐사 및 이용’편(Space Resource Exploration and Utilization)에서, “이 절에 따라 소행성자원 또는 우주자원의 상업적 채굴을 한 미합중국 국민은 취득한 모든 소행성자원 또는 우주자원에 대한 권리를 가진다. 그러한 권리는 미합중국의 국제적 의무를 포함하여 적용가능한 법에 따라 획득한 소행성 자원 또는 우주자원을 소유, 운송, 사용 및 판매할 권리를 포함한다.”고 규정하고 있다.이는 우주자원의 전유금지원칙을 규정한 기존의 외기권조약(Outer Space Treaty)에 부합하는지의 문제, 그리고 이러한 활동이 가능하다고 했을 때 어떠한 국제법적 규율의 틀이 적용되고 있고 또 적용되어야 하는지에 관한 근본적인 외교적, 규범적 질문을 던지는 주제이다.
본고에서는 우주자원의 탐사, 채취, 이용 등은 그 자체로는 외기권조약상 전유금지원칙 등에 위반되지는 않지만, 이러한 활동은 외기권조약 제IX조상 타국의 상응하는 이익을 고려할 의무 등 외기권조약상 제반 의무의 제약을 받게 되고, ‘지속가능한 개발의 원칙(the principle of sustainable development)’와 연계지어 이를 해석해보면 국가들은 상기 우주자원 관련 활동의 장기지속성을 도모하기 위해 일반적인 주의의무를 부담함을 논증해 나갈 것이다. 아울러 UN외기권평화적이용위원회(United Nations Committee on the Peaceful Uses of Outer Space; UNCOPUOS)를 비롯한 관련 국제사회의 논의도 이러한 흐름에 따르고 있음을 보여줄 것이다. 아르테미스 약정(Artemis Accords)의 서명국이자 UNCOPUOS 회원국으로서 우리는 이를 염두에 두고 우리의 입장을 수립해 나가야 할 것이다.
At a time when the problem of depletion of resources on earth and environmental pollution is emerging, the idea of using resources in space is emerging recently. Although it is impossible to economically realize large-scale resource extraction with the current technology, the possibility that it will emerge as another economic game-changer cannot be ruled out as technology develops in the future.
Amidst this backdrop, some countries, such as the United States, Luxembourg and Japan, are adopting national legislation allowing private entities to engage in space-resource related activities, raising legal questions as to the compatibility of such legislation with international law, such as Article II of the Outer Space Treaty on non-appropriation of outer space. This also raises difficult diplomatic and legal questions on how to regulate such activities, which leads to the question of how one should define the legal nature of outer space.
This article argues that even though the exploitation, exploitation and use of space resources cannot be deemed as itself unlawful under existing international law, the principle of sustaianble development, read together with other obligations under the Outer Space Treaty, imposes upon States an obligation to ensure that activities under their jurisdiction are conducted in a way that ensures long-term sustainability of such activities. The relevant discussions in the United Nations Committee on the Peaceful Uses of Outer Space(UNCOPUOS) also basically follow this logic. Korea should take this into consideration when forming its position on this issue, and participating in various international for a such as the Working Group on the Potential Legal Models for the Exploration, Exploitation and Use of Space Resources established under the Legal Subcommittee of UNCOPUOS at its 60th Session in 2021.
