이 논문은 최근 법무부가 입법 예고한 “동물은 물건이 아니다.”라는 조항의 철학적 의미를 밝히는 데 목적이 있다. 먼저 II절에서는 철학자들이 동물에게 도덕적 지위를 부여하는 논증을 소개한다. 동물에게 도덕적 지위를 부여하는 방식 중 하나는 인간 모두가 평등하게 도덕적 지위를 갖는 이유를 동물에게도 적용하는 것이다. 나는 이 유비 논증을 동물의 법적 지위에도 적용할 수 있다고 생각한다. 인간의 경우 모든 인간이 평등하게 도덕적 지위를 갖는다는 전제에서 그 법적 지위도 같아야 한다는 결론을 도출하고, 그것이 법률에 반영되어 있다. 그렇다면 마찬가지로 인간과 동물의 도덕적 지위가 같다면 그 법적 지위도 같아야 한다는 결론이 따라 나오는 것이다. III절에서는 동물을 물건으로 생각하지 않는 우리의 직관과 실제로는 물건으로 다루는 우리의 관행 사이의 모순을 프랜시오네의 용어를 빌려 ‘도덕적 정신 분열’이라고 부른다. 그리고 이 정신 분열을 치료하기 위해서는 동물에게 법적 지위를 부여해야 한다고 주장한다. IV절에서는 동물이 물건이 아니라는 조항을 진지하게 받아들였을 때 실제로 일어나는 변화가 어떤 것이 있는지 설명한다. 공장식 농장이나 동물 실험처럼 동물을 다루는 현재의 관행은 모두 동물을 물건으로 취급하는 것이므로 금지되어야 한다. 이는 우리 삶에 큰 변화를 가져오는 수준이므로 동물이 물건이 아니라는 조항은 단순히 선언적인 의미가 아니라 그 의미를 심각하게 받아들여야 한다는 것이 나의 주장이다. 맺음말에서는 동물에게 어떤 법적 권리까지 부여해야 하는지 논의하며 글을 매조지할 것이다. 미성년자나 외국인은 성인이나 내국인과 사람이라는 법적 지위는 같지만 법적 권리는 같지 않다. 마찬가지로 동물이 사람의 법적 지위를 갖는다고 하더라도 법적 권리까지는 같지 않을 것이다. 그렇다면 동물이 구체적으로 어떤 법적 지위를 가져야 하는지 논의한다.
The purpose of this paper is to clarify the philosophical meaning of the clause “Animal is not a thing,” recently announced by the Ministry of Justice. First, Section II introduces the argument that philosophers give animals moral status. One of the ways to give animals moral status is to apply the same reason why all humans have equal moral status to animals. I think this analogical argument can also be applied to the legal status of animals. In the case of humans, it is concluded that the legal status should be the same on the premise that all humans have equal moral status, and it is reflected in the law. If so, it follows the conclusion that if humans and animals have the same moral status, the legal status should be the same. In Section III, the contradiction between our intuition of not thinking of animals as things and our practice of actually treating animals as things is called “moral schizophrenia” by borrowing Francione's term. And it argues that animals must be given legal status to treat this moral schizophrenia. Section IV explains what changes actually occur when we take seriously the clause that animal is not a thing. Current practices in dealing with animals, such as factory farms and animal experiments, should be banned because they treat animals as things. Since this is a level that brings about a big change in our lives, my argument is that the clause that animals are not things is not just a declarative sentence, but that it should be taken seriously. In the conclusion, I will discuss and conclude about what legal rights to grant to animals. Minors and foreigners have the same legal status as adults and local residents, but their legal rights are not the same. Likewise, even if animals have legal status equivalent to human, their legal rights will not be the same. Thus, I will discuss the specific legal rights of animals.
