2019년 10월 말 동해상에서 북한 오징어잡이 선원 두 명이 동료 선원 다수를 살해한 뒤 남하하다 11월 2일 우리 군에 나포되었다. 곧이어 조사받은 지 3일 만에 본인들의 의사에 반하여 강제북송이 결정되고, 또 피포된 지 5일 만에 판문점을 통해 강제송환되는 사상 초유의 사건이 발생했다. 이 사건은 우리 사회에서 신중하게 검토해야 할 여러 가지 법적 문제를 낳았다.
첫째, 분단국의 특성 및 남북 분단의 현실, 서독의 선례, 인권 및 인도주의 등 여러 측면을 고려할 때 ‘남한 관할권 내 진입’과 함께 ‘귀순의사의 표시’는 북한이탈주민에게 대한민국 국적 인정을 위한 내재적 요건이라고 볼 수 있다. 이는 일종의 절차적 요건 내지는 국가의 국적 확인 의무를 발동시키기 위한 요건일 뿐, 국적법에서 요구하는 요건 이상의 별도의 실체적 요건을 추가하는 것을 의미하는 것은 아니다. 차제에 북한이탈주민의 국적 인정에 관한 요건과 절차를 법제화할 필요가 있다.
둘째, 귀순의사의 ‘진정성’이란 개념은 의사표시의 존부 및 하자가 없다는 점을 넘어서서 해당 북한 주민을 보호할 가치가 있는가에 관한 정책적 판단까지 포함하는 것으로 여기에는 다분히 주관적이고 자의적인 판단이 개재될 위험이 있다. 따라서 북한이탈주민의 국민 인정을 위한 ‘귀순의사’의 진정성을 요구하는 것은 대한민국의 대인고권과 헌법 제10조의 국민보호 의무를 임의로 축소하는 것으로 위헌적이라고 보아야 한다.
셋째, ‘귀순의사의 진정성’ 판단을 위한 정부 관계기관 합동조사는 행정조사의 일종으로서 합동조사의 판단은 위장 귀순 여부를 가려내기 위한 것에 국한되어야 한다. 어떤 경우에도 행정조사의 결과로써 살인죄 등 범죄의 유무를 확정적으로 판단할 수 없다. 이번 사건에서 나타난 관계기관 행정조사는 전후 사정에 비추어 무죄추정의 원칙, 적법절차의 원칙이 준수되지 않았음이 분명하다. 특히, 불리한 진술 거부권 고지 및 변호인의 조력을 받을 권리 보장 등이 적용되지 않았다. 그러므로 탈북 선원들의 자백이나 관련 진술조서는 형사소송절차에 있어 증거능력을 갖지 못한다.
넷째, 문재인 정부가 관계기관 합동신문의 결과를 바탕으로 살인죄를 범한 흉악범이라고 단정하고 귀순의사의 진정성을 문제 삼아 단행한 강제북송은, 행정부가 사법부가 마땅히 해야 하는 유죄판결 및 사실상의 범죄인인도 결정을 직접 해버린 월권행위이자, 위헌·위법적인 결정이었다. 게다가 이의신청 및 재판청구 등 불복절차에 호소할 권리도 인정되지 않았다. 앞으로 이 같은 조치가 재발하지 않도록 관계 법령을 정비하여 불복절차의 인정 등 관계기관 합동조사의 절차 및 과정에 대한 민주적 통제를 모색하는 한편, 사법부의 개입 및 적절한 통제를 제도화시킬 필요가 있다.
At the end of October 2019, two North Korean squid fishing crew members killed a number of their fellow crew members in the East Sea and were captured by the South Korean military on November 2, 2019. Soon after, three days after the investigation, the forced repatriation was decided against their will, and five days after they were arrested, a case of forced repatriation occurred through Panmunjom. This unprecedented case raised a number of legal issues that should be carefully considered.
First, considering the characteristics and reality of inter-Korean division, West Germany’s precedent, human rights and humanitarian principles, ‘expression of intention to defect to and obey the Republic of Korea (ROK or South Korea)’ can be seen as an intrinsic requirement for North Korean defectors to recognize ROK’s nationality. This is only a kind of procedural requirement or a requirement to fulfill the state’s duty to identify nationality. But it does not mean adding a separate substantive requirement beyond the requirements required by the Nationality Act of South Korea. With this opportunity, it is necessary to legislate the requirements and procedures for recognizing the ROK’s nationality of North Korean defectors.
Second, the concept of “authenticity” of a will to defect to ROK could include a policy decision on whether it is worth protecting the North Koreans beyond the presence or absence of an indication of intention, which may involve subjective and arbitrary judgments. Therefore, demanding the authenticity of a “will to defect to ROK” for the recognition of ROK’s nationality should be regarded as unconstitutional on account of arbitrarily reducing the personal jurisdiction of the ROK and the state’s obligation to protect people under Article 10 of its Constitution.
Third, a joint investigation by government-related agencies to determine the authenticity of intention of defection is a kind of administrative investigation, and judgment of the joint investigation should be limited to identifying whether or not it is disguised. In any case, the existence or absence of a crime such as murder cannot be definitively determined as a result of an administrative investigation. It is clear that an administrative investigation of related agencies in this case did not comply with the principle of presumption of innocence and due process of law in light of all the relevant circumstances. In particular, notification of a right of refusal to testify against oneself and guarantee of a right to receive legal assistance from lawyers were not carried out in this case. Therefore, confessions or related statements of North Korean defectors do not have the evidence capacity in criminal proceedings.
Fourth, the forced repatriation, backed up by the Moon Jae In government’s conclusion that the North Korean defectors were felons who committed murder, based on the results of an administrative investigation, can be evaluated as an unconstitutional and unlawful decision that the administration unilaterally made without judicial intervention or control. In addition, a right to resort to appeal procedures, such as filing an objection and requesting a trial, was not recognized. In order to prevent such measures from recurring in the future, it is necessary to amend related laws and regulations to seek democratic control over the procedures and process of joint investigations of related agencies, such as introduction of objection procedures.
