본 논문은 북한주민의 남한 내 재산에 대해서 재산관리인을 통하지 않은 법률행위를 규율하는 남북가족특례법 제15조 및 이와 관련된 제19조의 해석상 논점을 검토하고, 그 법리적 해결방안을 제안하고 있다.
먼저 특례법 제15조 본문은 북한주민의 취득재산에 대해서 재산관리인을 통하지 않고 한 법률행위를 무효로 규정하고 있다. 여기서 위 규정의 문언만으로는 북한주민이 직접 한 행위 또는 임의대리인을 통해서 한 행위만을 무효로 하는 것인지, 아니면 재산관리인을 통하지 않고 한 일체의 법률행위를 모두 무효로 하는 것인지가 불명확하다. 따라서 북한주민이 취득재산에 대해서 직접 한 행위와 임의대리인을 통해서 한 행위가 금지되는 것임을 특례법 제15조에 구체적으로 명시하는 것이 필요하다.
또한 북한주민의 취득재산에 대해 재산관리인을 선임하지 않고 한 행위가 유동적 무효임을 명시하고, 나아가 선의의 상대방 및 제3자 보호 규정을 특례법 제15조 본문에 두는 것이 필요하다.
그리고, 특례법 제15조 본문의 “무효로 한다.”를 개정함에 있어서, 제1안으로서 유동적 무효에 관한 규정인 민법 제130조(무권대리)와 같은 모습으로 개정하는 것, 제2안으로서 ‘2013년 법무부 민법개정시안’ 제139조의2(무권리자의 처분) 제2항과 같은 모습으로 개정하는 것을 제안한다.
다음으로 특례법 제15조 단서는 제19조의 ‘북한주민의 직접 사용·관리 등’의 규정에 따라 인도주의적 차원에서 이루어진 일정한 행위에 대해서는 유효로 다루고 있다. 그런데 특례법 제19조 제2항은 그 행위의 범위를 민법 제777조의 친족으로 하고 있어서 지나치게 넓다. 따라서 이는 부양의무를 기준으로 하는 민법 제974조에 따른 친족의 범위로 개정함이 합당하다.
또 특례법 제15조 단서에 따른 제19조 제3항은 국가안전보장, 질서유지 및 공공복리를 고려하여 법정조건을 붙일 수 있도록 하고 있다. 그러나 조건 이외에 기한도 붙일 수 있는 것으로 개정됨이 타당하다.This paper reviews the issues in the interpretation of Articles 15 and 19 of the Act on Special Cases for Inter-Korean Families (the Act on Special Cases Concerning Family Relationship, Inheritance, etc. Between Residents in South and North Korea), and proposes legal amendments to solve the problems.
First, the main text of Article 15 of the Act on Special Cases states, “A legal act done other than through a legal property manager with regard to inherited or bequeathed property shall be void.”
However, it is unclear whether the wording alone invalidates only acts performed by North Koreans directly or through a de facto agent without going through legal property managers or all acts done without legal property managers.
Therefore, it should be explicitly stated in Article 15 that acts on the property in South Korea performed by North Koreans directly and through a de facto agent are prohibited.
In addition, in the main text of Article 15 of the Act on Special Cases, it is necessary to provide a provision to protect the bona fide third parties regarding acts performed without the appointment of legal property managers for the North Korean’s property in South Korea.
Next, the provision to Article 15 of the Act on Special Cases states that the foregoing shall not apply on acts performed with permission from the Minister of Justice in accordance with Article 19.
Here, Article 19 (2) of the Act on Special Cases states that the standard of effective acts is based on the scope of relatives in Article 777 of the Civil Law. But, since the scope is too wide, it should be amended to ‘relatives bearing the duty of support’ in Article 974 of the Civil Law.
In addition, Article 19 (3) of the Act on Special Cases states, that when the Minister of Justice intends to issue a permit under paragraph (1), he/she may attach conditions to the permit, as prescribed by Presidential Decree, taking into consideration national security, the maintenance of order, and public welfare.
Here, it should be amended to allow for a deadline in addition to conditions stated by the law in order to ‘effectively manage the North Koreans’ property in South Korea’ and ‘promote the stability of legal relations.’
