블록체인 기술은 화폐경제를 넘어 기업 및 조직 거버넌스와 정부 운영 및 행정 서비스 전반에서 활용 가치가 있는 기반 기술로 논의되고 있다. 본 논문은 블록체인이 단순한 기술을 넘어 탈근대시대의 철학 및 정신을 함축하고 있으며, 나아가 민주적 거버넌스와 같은 거시적인 담론 역시 이끌고 있다는 기본 전제에서 논의를 시작한다. 블록체인 기술에 기반한 탈중심적 거버넌스는 사적 주권 및 사적 자율성의 복원, 민주주의 및 보충성 원칙의 실질화, 국가권력에 대한 실효적 통제를 비롯한 민주적 함의를 내포하고 있다. 이는 (사적 개인의 자유 보장에 대한 지향점과 근대국가의 형성원리로서 사회계약론에 대한 구상과 같이,) 계몽주의 정치철학의 고전적 쟁점들을 탈근대 시점에서 다시금 성찰해보도록 하는 계기를 마련해준다. 블록체인과 같이 기존의 체계를 새로이 전복적으로 재편성하는 이른바 ‘와해적 기술’은 큰 정부의 등장 및 비대화, 국가권력의 남용 가능성, 정부의 실패, 대의 민주제의 한계를 비롯해, 현대사회에서 근대적 국민국가의 민주적 정당성이 위기에 봉착해 있다는 비판과 밀접하게 관련되어 있다. 이렇듯 블록체인 기술의 정치철학적 함의는 근대적 국민국가의 기능 및 역할과 통치 방식에 있어서 새로운 전환을 꾀하고 있다는 점에서 탈근대성과 탈국가성, 그리고 세계주의를 함축하고 있기도 하다.
블록체인 기술을 둘러싼 담론에 있어서 난제는 기술이 지향하고자 하는 고유한 철학적·사상적 정체성을 유지하면서도 법공동체의 틀에서 다루어질 수 있기 위한 생태계를 구축하는 것이라고 할 것이다. 블록체인 기술은 사적 개인이 다양한 지층에서 자율적인 탈중심적 공동체를 생성·운영할 수 있도록 하며, 이는 새로운 규범적 공간이 자생적으로 창출되고 다양한 형태의 법규범이 형성될 수 있음을 의미한다. 이때 오늘날 블록체인 민주주의 담론을 이끌고 있는 기술적 자유주의 또는 기술적 아나키즘과 같이, 국가중심적 권력 및 규범의 통제로부터 완전히 자유로운, 일종의 규범공백적 공동체를 지향하는 관점과는 분명한 거리두기가 필요하다. 이를 위해 규제다원주의 및 ‘거버넌스로서 법’을 통한 절차주의적 방향성이 의의를 갖는다고 하겠다. 이와 더불어, 블록체인 기술의 탈중심적 거버넌스 논의에서 발견될 수 있는 이론적 부족분들이 보완되어야 할 것이다. 예컨대 지나치게 원자화·파편화된 인간상의 한계를 넘어서 사회적 연대성에 기반한 규범적 공동체의 구성원으로서 사적 개인이 전제되어야 할 것이며, 채굴자 및 코드 개발자 등이 주도하는 테크노크라시와 같이 블록체인 거버넌스에 내재하는 비민주성 역시 근본적으로 교정될 수 있어야 할 것이다.
Blockchain technology, leading the decentralized monetary economy, is considered an underlying technology that can be utilized throughout corporate governance and government administrative services. This article begins with the fundamental premise that blockchain is not just mere technology but also implies the philosophy and spirit of the postmodern era and discourses of democracy and governance. Decentralized governance based on blockchain technology has democratic implications, including restoring personal sovereignty and autonomy, substantializing democracy, and effectively controlling state power. This discussion provides an opportunity to reflect on central themes of Enlightenment political philosophy, such as the social contract theory as a principle of formation of the modern nation-state and the guarantee of individual freedom. Blockchain as the ‘disruptive technology’ that reorganizes the existing system in a subversive way is closely related to the criticism of the emergence of big government, the abuse of state power, the failure of the government, and the limitations of representative democracy, which impairing the democratic legitimacy of the nation-states. As such, blockchain technology’s political and philosophical implications also imply postmodernity, trans-sovereignty, and cosmopolitanism in that it is seeking a new transition in the function and role of the state.
Furthermore, the challenge in the blockchain technology discourse is to build an ecosystem that can be dealt with within the legal and political realm while maintaining the unique philosophical and ideological identity the technology pursues. Blockchain technology enables private individuals to create and operate autonomous decentralized communities, which means that new normative spaces and various legal norms can be spontaneously formed. Here, it is necessary to keep a precise distance from the perspective of pursuing a kind of norm-void community utterly free from the control of state-centered power, such as technological liberalism or technological anarchism that is leading the discourse of blockchain democracy today. Therefore, it is meaningful to discuss the direction of proceduralism through regulatory pluralism and ‘law as governance.’
