사회보장법은 사회문제와 그 변화를 충실히 인식하고 이에 대한 처방을 제도화하여 개인의 생활을 안정적으로 보장하여야 한다. 이 글에서는 이와 같은 제도 목적에 비추어 우리 사회보장법을 비판적으로 검토하고 사회 및 사회문제가 변화하는 상황에서 사회보장법의 진행방향을 서술한다. 이때 역사적으로 형성된 사회보장입법이 특정한 체계를 형성한다는 점을 주목하였다. 이와 같은 사고는 다양한, 그리고 새로운 사회문제에 대한 규범적 처방을 논의하는 준거가 될 수 있으며, 그 결과 진행방향에 대한 논의가 안정성을 갖는다는 장점이 있다. 다만 사회문제와 사회보장법의 미완성성 및 개방성에 비추어 보면 이는 엄격한 체계가 될 수는 없다. 즉 기존의 체계를 구성하는 요소를 변형하거나 새로운 요소가 보충되어야 하며, 이 점에서 체계의 사고와 개별 사회보장법 및 사회보장법이 규율하는 대상의 다양성과 가변성은 어느 정도 긴장관계에 있다.
우리 사회보장법이 형성하는 체계는 ‘낮은 수준의 평등한 복지’와 사회적 위험 및 상황을 ‘다원적 제도의 기능적 협력관계’에서 ‘사회보험을 중심으로’ 보장한다는 특징으로 요약된다. 이 점은 1990년대 이전 시기의 사회보장입법에서 확인될 수 있었다. 1990년대 진행되기 시작한 세계화, 1990년대 말 우리의 외환위기, 2007-08년 전 세계가 겪은 재정위기는 우리 사회보장법의 체계를 다시 정비하고 보충하는 계기가 되었다. 노인빈곤과 노동빈곤이 보편화되었다. 산업구조와 노동시장의 변화로 인하여 노동 및 소득이 불안정하고 그 결과 복지생산과 연계되지 못하는 것이 근본적인 문제였다. 노동은 자체가 복지를 생산하는 장(場)이 되어야 하며, 이에 고용은 고용보험의 과제이지만 동시에 국가과제의 성격을 강화하여야 한다. 고용보험이 보호할 수 없는 대상자를 사회 및 노동시장에 다시 진입시키기 위하여 기존의 공공부조는 적극적으로 구성되어야 한다. 노동과 소득, 그리고 복지생산의 선순환이 회복되어야 한다. 이를 위해서는 노동시장의 유연화에 상응하여 복지생산의 구조가 유연화 되어야 한다. 사회보험에서 노동법상의 근로자 개념에 구속되지 않고 보호의 필요성을 기준으로 비정규직·비전형적인 고용유형으로 가입대상을 확대하여야 한다.Social security law should understand the social problems and their change to institutionalize the necessary measures and finally to secure the decent livelihoods of the individual. This article aims to critically analyze the current social security law and to propose the policy direction facing the changing social structure. It is based on the system, which was formed in the course of the historic development of the social security law in Korea. This way of approach is useful in that it delivers a stable reference for the discourse about the normative reaction to the diverse and new social problems. However the strict meaning of system is not envisaged, because the social problems and social security law is characterized as incomplete and open. I.e. the existing system should be modified or supplemented with new institutional elements, and in this regard the system thinking is in some degree tensely related with the diverse and compl ex social problems.
The social security law in Korea can be in terms of system thinking characterized as follows; The social risks and situations should be protected basically through social insurances, which function in the cooperation among various social insurances themselves and with other kind of social institutions which equally provide the low level of social benefits. This character could be confirmed in the development of the social security legislation until 1990. The globalization, foreign exchange crisis of Korea, and global financial crisis motivated the system of social security law to realign and supplement it in Korea. The elderly poverty and working poor spread wiedely. Facing the change of the industrial structure and labor market the employment and income become unstable which is then connected with the unstable welfare production. In this context the labor itself should produce the welfare on the one hand, employment policy should be beyond the unemployment insurance enforced as a state task. Public assistance should be activated to support the persons to whom the unemployment insurance cannot be applied to enter into the labor market. The circulation among the labor, income and welfare production should be recovered. To this purpose the welfare production should be made flexible in accordance with the flexibilization of the labor market. Social insurances should be applied beyond the traditional type of work also to the irregular work and untypical type of work on the base of the necessity of social protection.
