이 글은 사회보장 관련 주요 헌재 결정들을 통해 사회보장 영역에서의 헌법재판의 의의 및 과제에 대하여 살펴본다.
대한민국헌법은 제정 이후 오늘날에 이르기까지 사회보장을 국가적 과제로 인식하여 왔다. 우리 헌법은 사회보장에 관한 일반조항과 함께 빈자, 장애인을 포함한 사회적 약자를 위한 특별조항을 두고 있는데, 이러한 헌법규정의 존재는 사회보장에 관한 법령의 합헌성 결정에 상당한 영향을 미친 것으로 보인다. 헌법재판소는 지난 삼십여 년간 사회보장에 관한 국민의 권리를 보호하는 데 중요한 역할을 담당해 왔다.
헌법재판소는 인간다운 생활을 할 권리를 비롯한 사회적 기본권의 권리성을 확인하였을 뿐만 아니라, 사회보장의 이념적 기반이 되는 사회연대를 헌법적 원리로 인정하여, 사회보장제도의 중핵인 사회보험제도의 헌법적 기반을 공고히 하고, 구체적으로 사회적 약자의 권리를 보호하는 데에 상당한 기여를 하였다. 앞으로 사회보장에 관한 헌법재판의 이론과 실무에서 실질적으로 중요한 과제는 인간다운 생활을 할 권리와 사회보장권의 구체적 내용 규명과 이 기본권 보장의 취지를 실질적으로 담보할 수 있는 사법심사 기준의 정립 문제라 할 것이다.This paper examines the significance and challenges of the constitutional adjudication in the area of social security through major decisions of the Constitutional Court.
The Constitution of Korea has recognized social security as a national responsibility from the moment of its enactment until today. Along with general provisions on social security, the Constitution has special provisions for the socially underprivileged, including the poor and the disabled. The existence of these constitutional provisions seems to have had a significant impact on the constitutionality of social security law.
The Constitutional Court has played an important role in protecting the people's right to social security over the past thirty years. The Constitutional Court not only confirmed the legal enforceability of the social basic rights, including the right to a humane livelihood, but also recognized social solidarity, which is the ideological basis of social security, as a constitutional principle. Through this, the Constitutional Court has made significant contributions to solidifying the constitutional basis of the social insurance system, the core of the social security system, and specifically protecting the rights of the socially underprivileged.
In the future, a practically important task in the theory and practice of constitutional adjudication on social security is to clarify the specific contents of the right to a humane livelihood and the right to social security, and to establish judicial review standards that can effectively guarantee the purpose of assuring these basic rights.
