이 연구는 인권의 현황이 열약한 모습을 보여주고 있기도 하지만 그렇더라도 세계입헌주의 발전, 그것의 보장체계 구축인 세계인권헌장 제정, 세계인권재판소 창설의 방안을 모색해 보고자 하는 것이다. 헌법의 내용이나 정치체제가 나라마다 차이가 있을지라도 헌법은 보편가치를 담게 된다. 바로 인권보장원칙, 민주주의, 자유주의, 권력분립원칙, 복지주의, 평화주의 등의 헌법적 가치는 공통적으로 받아들여진다. 인권을 실정권으로 본 독일의 나치스의 등장, 2차대전의 인권유린을 겪고 자연권으로 복구하여 자연권으로서 발달하는 역사를 볼 수 있다. 인권은 폐쇄적인 것이 아니고 확대되는, ‘있어야 할’ 인간의 천부의 권리로서 자연권이고 인류의 보편적 가치이다. 한국 현행헌법도 제10조 후문이 “국가는 개인이 가지는 불가침의 기본적 인권을 확인하고”라고 하여 (천부)인권성, 불가침성을 인정하고, 자연권으로 보므로 이를 ‘확인’한다고 하고 제37조 제2항이 본질적 내용 침해 금지를 규정하는 등 인권을 자연권으로 보는 입장을 분명히 하고 있다. 개별 국가별 가치에서 보편가치를 발견할 수 있다. 동양적 인권가치로 인간중심・존중, 인간의 고유한 권리를 인정하는 이론 내지 사상이 일찍이 발달해 왔다. 불교의 자애사상(‘천상천하 유아독존’), 유가(儒家)의 민본사상(民本思想) 등을 들 수 있다. 한국에서도 인간중심적 가치관이 일찍이 나타났고 단군신화에 나타난 “인간애, 자연친화적 인간상, 위민사상이 그러하다. 근대 개화기에 동학(東學)에서 나타난 인내천(人乃天) 사상 등 인본주의(人本主義) 사상도 전개되었다. 1919년 일제에 항거하여 나온 기미독립선언서에도 인간존엄, 인도주의 정신이 표명되어 있다. 이러한 인간의 존엄, 인간존중사상이 동서양을 막론하여 세계적으로 널리 받아들여질 인류공동체적 보편적 헌법가치가 될 수 있으므로 공동체의 통합, 발전을 가져오는 동력이 되고 세계입헌주의의 가능성을 발전시켜야 한다. 인권보장의 체계의 개선・발전이 다음과 같이 요구된다. 첫째, 체계화를 통한 헌법규범의 확대와 치밀성 확보를 가져올 수 있다. 체계화로 이루어진, 씨줄, 날줄이 촘촘한 그물망(net)으로 기본권규범이 보다 확대되고(이는 기본권의 파생과 연관된다) 그 보장이 좀더 치밀해진다는 것이다. 둘째, 인권가치의 보편성 확산, 셋째, 기본권규범의 확대, 넷째, 인권규범의 적극적 해석과 운용(집행), 다섯째, 외국인에 대한 기본권보장(이로써 세계의 입헌주의와 인권보장이 더 강화된다. 한국은 2014년 국회의 헌법개정자문 위원회의 개정안에서는 현재 각 개별 기본권들에서 ‘국민은’이라고 규정된 헌법조문들을 대부분 ‘사람은’으로 개정할 것을 제안한 바 있다), 여섯째, 기본권제한에서의 법률의 적극적 임무수행, 마지막으로, 인권실천 역할자(헌법재판소, 대법원 등)의 조직의 독립성, 전문성 강화가 중요하다.
그동안 유럽지역, 국제연합 등에서의 국제적 인권보장확대 노력이 있었고 한국에서도 세계헌법대회(WCCL of IACL)를 개최하는 등 인권보장에 기여하려고 하였다. 미래를 향한 공동의 노력이 필요한데 오
늘날 인공지능(AI) 시대, 팬데믹 상황에서 이미 변곡점을 맞이하였다. 그럼에도 한국에서는 젊은 헌법학자들의 교류 국제세미나인 GYIP 등을 개최하는 등 미래를 향해 나아가는 노력을 하고 있고 이 노력이 필요하다. 그리고 세계적 보편적 인권가치를 담은 세계인권헌장의 제정이 필요한데 그 합의 등이 쉽지는 않을 것이다. 세계인권재판소는 세계인권헌장을 뒷받침하기 위해 필요하다. 그런데 그 창설을 위해서는 국가들 간의 공감대 형성을 비롯하여 그 구성을 어떻게 할 것인가 하는 조직, 관할, 심판대상, 기존의 국내 법원들과, 인권재판소들 간의 관계를 어떻게 정립할 것인지, 그 제소절차, 그 결정의 기속력, 집행력확보 방안 등에 있어서 어려운 점들이 적지 않다.
이러한 난제들이 있다고 하여 주저앉아 있기만 할 것이 아니라 조금씩 세계인권헌장을 우선 합의될 수 있는 부분부터 끌어내고 세계인권재판소의 설립도 그 방안을 모색하기 시작하는 노력하는 것이 필요하다. 각 국가에 여지를 주면서 단계적으로 넓혀가는 인내와 지혜가 필요할 것이다. 그러한 과정에 의미 있는 연구로서 기여하는 것이 바로 헌법학자들의 소임이다.Although the current human rights protection system remains inadequate, this study aims to explore ways to develop global constitutionalism and also establish a Universal Human Rights Charter as well as a World Human Rights Court, which are an institutional guarantee of global constitutionalism. While the substance of a constitution and political system may differ from country to country, constitutions contain certain universal values. The constitutional principles of human rights guarantees, democracy, liberalism, the separation of powers, welfarism, and pacifism are accepted as common values. We can see the history of recovering to and developing into natural rights after the emergence of the Nazis in Germany that had a view of human rights as positive rights and after massive human rights abuses during World War II. Human rights are natural rights as innate rights that all humans ‘should have’ and a universal value of humanity, which is not limited but expanded. The Constitution of Korea provides in the second sentence of Article 10 that “[i]t shall be the duty of the State to confirm and guarantee the fundamental and inviolable human rights of individuals,” thus confirming the innate nature and inviolability of fundamental rights, thereby recognizing it as natural rights. Article 37(2) of the Constitution provides no violation of essential aspects, thereby making clear its position that fundamental rights are natural rights. Universal values can be found in the values of each country. Theories and human-centered thinking about respect for humanity and the innate rights of humans developed early on as Asian human rights values, with examples including the Buddhist idea of self-compassion (“On heaven and earth, I alone am honored”) and the Confucian idea that people are the foundation of the polity. Human-centric values arose early in Korea as well, an example from the founding mythology of Dangun being love of humanity, a vision of humans in harmony with nature, and the concept of rule for the people. The Enlightenment Period at the cusp of modernity also saw the rise of revolutionary ideology that recognized humanism as an important value, such as the Innaecheon (人乃天, ‘divinity within humans’) doctrine of Donghak. The Korean Declaration of 1919 in resistance to Japanese imperial rule also expresses the spirit of human dignity and humanitarianism. Since this idea of human dignity and human respect can be a universal constitutional value of the human community that will be widely accepted worldwide, we should develop the possibility of global constitutionalism that is a driving force for the integration and development of the community. A system of human rights guarantees are required. 1. The expansion and elaboration of constitutional norms can be achieved by systemization. Fundamental rights norms are expanded thanks to the fine web(net) woven by systemization (this is also connected to the derivation of fundamental rights), and the guarantees are further elaborated. 2. The Universal Expansion of Human Rights Values 3. The Expansion of Fundamental Rights Norms 4. The Proactive Interpretation and Operation (Enforcement) of Human Rights Norms 5. Guaranteeing fundamental rights of aliens(Accordingly, global constitutionalism and human rights guarantees can be strengthened. In the draft constitutional amendment of the 2014 National Assembly Consultation Committee for Constitutional Amendment, it is proposed that most of the constitutional provisions granting individual fundamental rights to “citizens” be amended to read “persons.” 6. The Proactive Role of Statutes in Restrictions on Fundamental Rights 7. The Independence and expertise of the institutions guaranteeing human rights (Constitutional Court, Supreme Court and etc.) are important.
So far, efforts have been made to expand international human rights guarantees in Europe and the United Nations, and Korea has also tried to contribute to human rights guarantees by holding the World Congress of Constitutional Law (WCCL of IACL). Joint efforts toward the future is necessary and we have already reached an inflection point in the pandemic situation and the age of artificial intelligence (AI). Nevertheless, Korea is making efforts toward the future by holding GYIP, an international seminar for academic exchanges of young constitutional scholars, and this effort is needed. There is a need for a universal human rights Charter that reflects global and universal human rights value, but consensus will not be easy to reach. A World Human Rights Court needs to be established to support the Charter. In order to establish it, however, there are many difficulties in terms of how to build a consensus among countries, organization and composition, jurisdiction, objects of adjudication, relationship with existing domestic courts and human rights courts, procedures and measures to ensure the binding forces and enforceability of decisions.
Despite these challenges, we should not just sit down and wait, but gradually draw out a universal human rights Charter from the point where it can be agreed first, and try to find a way for establishment of a World Human Rights Court. It will take patience and wisdom to expand step by step while giving room to each country. Constitutional scholars have a meaningful role in such research activities.
