최근 헌법재판소의 명예훼손죄에 대한 결정은 표현의 자유보다는 명예훼손처벌을 통해 인격권을 보호하겠다는 관점이 반영된 것으로 보인다. 인격권 보호의 중요성이 충분히 인정되고, 명예침해에 대한 회복의 어려움도 고려되어야 할 것이다. 그러나 이미 현재의 형사처벌법제가 인격권 보호의 관점에서 구축되어 있고, 이러한 상황에서 표현의 자유에 대한 축소된 보호를 회복시키기 위한 기준으로서 관건이 되는 명예훼손죄 위법성조각사유의 공익성 요건이 제 기능을 하기 어렵기 때문에, 표현의 자유를 행사하는 자는 명예훼손죄의 형사책임을 감수하거나 위법성이 조각될 수 있을지 전적으로 사법부의 판단에 맡기게 되는 불확실성을 감수하지 않고서는 표현의 자유를 행사하기 어려울 수 있다. 불명확한 기준으로 인하여 처벌대상이 될 것인지, 위법성이 조각될 수 있는지 사법부의 판단 여하에 맡겨져 있다는 점은 표현의 자유에 대한 위축효과를 야기하게 된다. 인격권을 비롯한 법익 보호도 중요하지만, 이것을 과연 제재 자체로서도 가장 강력한 것이면서 위축효과까지 야기할 수 있는 형벌법규를 통해 달성해야 하는 것인지, 이로 인하여 민주사회에서 필수적인 의사소통과 비판 및 감시기능을 제한하게 되는 것은 아닌지 그 해악의 결과에 대하여도 진지하게 숙고해볼 필요가 있다.The recent Constitutional Court's decisions on defamation seem to have given priority to protecting personal rights rather than freedom of expression. The importance of protecting the reputation is fully recognized, and the difficulty of recovering from damage to the reputation should also be considered. However, the current criminal law system has already been established for the protection of personal rights. In this situation, in order to restore the reduced protection of freedom of expression, the element of public interest is important as a ground for the illegality of defamation. However, the interpretation of this requirement is too wide to function properly. Therefore, it may be difficult for people to exercise their freedom of expression without taking the criminal responsibility for defamation or the uncertainty of the judgment of the judiciary. The ambiguity of the criteria that separates these punishments and exemptions causes a shrinking effect on freedom of expression. Protecting honor and rights is important, but it can also be questioned whether this should be achieved through criminal punishment. It is necessary to seriously consider whether the defamation punishment reduces the functions of democratic communication and monitoring government, which are essential in a democratic society.
