본 논문은, 법령 위임으로 제재적 행정처분의 기준을 정한 행정입법인 부령(部令)의 법적 성격에 대한 대법원의 자체 모순적이고 비논리적인 기존 판례의 변경을 다시금 촉구함으로써, 훼손된 국가법령체계를 명확히 재확립하고 부수적으로 관련 사안에 대한 사법심사에 있어서 올바른 법적용 내지 심사방식의 개선방안을 제시하고자 한 것이다.
그동안 대법원은 제재적 행정처분의 기준이 헌법상 인정된 행정입법의 형식인 (행정각부의) 부령(법시행규칙)으로 정해지더라도 그것은 행정청 내부의 사무처리준칙을 정한 것으로서 행정규칙(행정명령)의 성격을 갖는 것에 지나지 않으므로, 대외적으로 국민이나 법원을 구속하는 법규명령으로서의 효력은 인정되지 않는다고 보았다. 그리고 그러한 부령의 법규적 효력을 부인함에 따라, 개별 사안에서의 당해 처분의 적법 여부는 부령에서 정한 기준에 부합하는지가 아니라 처분의 근거법률의 규정 및 취지에 적합한지 여부에 따라 판단하여야 한다고 법적용 내지 사법심사의 방식을 제시하기도 하였다.
이러한 대법원의 태도에 학계에서 다양한 평가와 해석이 제기되어 온바 대체로 비판적인 견해가 우세하였던 것으로 보인다. 하지만 대법원의 입장은 여전히 변함없는 상황인데, 이로 인하여 제재적 행정처분의 기준을 정한 부령과 관련하여 국가법령체계에 대한 이해에 있어서 기본적인 오류 내지 혼란이 초래되고 있고, 또한 관련 사안에 대한 법적용 내지 사법심사방식에 있어서도 문제의 소지가 있는 것으로 판단된다.
본 논문에서는 이 쟁점과 관련하여, 우선 그동안 대법원이 그러한 판례태도를 유지하여 온 배경과 연원 등에 대하여 정리․분석하였고, 그와 같은 대법원 판례태도가 초래하고 있는 법리적․법체계상의 문제점을 재검토함으로써 판례의 오류(誤謬)를 거듭 논증하고자 하였다. 그리고 결론적으로 법해석에 관한 최종적 유권해석기관인 대법원이 이 쟁점에 관한 기존의 판례태도를 이제는 명확히 변경하여야 함을 촉구하고자 한다. 그리고 이와 같은 과정을 통하여, 결과적으로 국가법령체계에 대한 이해를 보다 명확히 하여 국가법질서를 재확립하고, 관련 사안에 대한 사법심사에 있어서도 올바른 법적용 내지 심사방식을 제시하고자 하였다.
대법원이 법령의 명시적 위임이 있으면 훈령 등 행정규칙의 형식으로 정해진 규범도 법규명령적 효력을 인정하고 있는 마당에, 동일한 입법권 위임의 원리와 법률상의 명시적 수권규정에 따라 헌법상의 부령으로 정하여진 규범의 법규명령적 효력은 오히려 부인하여 온 태도는, 법령체계적 관점이나 법논리적 측면, 나아가 법적용의 현실적 관점에서도 더 이상 타당성을 인정받기 어려울 것으로 판단된다.
본 쟁점대상인 부령이, 헌법에 근거한 합법적 수권방식과 절차에 따라 제정되어 법규명령의 성격을 가지게 된 규범임에도 위와 같은 대법원의 자체 모순적이고 비논리적인 해석에 의하여 현행 국가법령체계에 있어서는 배제되게 되는 부당한 결과가 초래되고 있는바, 이는 국가법령체계의 정립 내지 올바른 법령체계의 이해의 관점에서도 더 이상 묵과할 수 없는 결과이며, 그러한 해석적 오류로 인해 야기되는 개별 사안에서의 법적용 내지 사법심사의 오류 역시 교정·개선되어야 한다고 판단하였다. 이에 따라 본 논문에서는 대법원으로 하여금 법령의 위임에 의하여 제재적 행정처분의 기준을 정한 부령의 법적 성격 등과 관련하여, 그동안의 모순적이고 비논리적인 관련 판례의 변경을 조속히 단행하여 줄 것을 재삼 촉구하고자 한다.
This paper aims to establish the national legal system more clearly and incidentally correct legal application or judicial review methods for related issues by urging the Korean Supreme Court to change its own contradictory and illogical precedents on the legal nature of the subordinate decree, which sets the standard for sanctioned administrative disposition.
Until now, the Supreme Court considered that even if the standard of sanctioned administrative disposition was set by the Ministry of Government Administration (the Enforcement Rules), which is a constitutionally recognized form of administrative legislation, it is nothing more than an administrative rule (administrative order), so it is not recognized as a legal order that binds the people or courts. In addition, the Supreme Court denied the legal effect of the department decree setting the standard for sanctioned administrative disposition, suggesting that the legality of the disposition in individual cases should be determined according to the provisions and purposes of the underlying law.
Various evaluations and interpretations have been raised in academia, and generally critical views have prevailed on the consistent and firm position of the Supreme Court. However, the Supreme Court's position is still unchanged, which is believed to cause basic errors or confusion in understanding the national legal system in relation to the legal nature of the department ordinance (law enforcement rules) that sets the standard for sanctioned administrative disposition.
In this paper, first of all, the background and origin of the Supreme Court's attitude toward precedent were analyzed, and the legal and legal system problems caused by such attitude were reviewed to prove the error of precedent. In conclusion, I would like to urge the Supreme Court, the final authoritative interpretation agency on legal interpretation, to clearly change the conventional precedent attitude on this issue. Through this process, the government tried to establish a national legal system by clarifying its understanding of national laws and order, and to present a more desirable method for legal application or judicial review in related individual cases.
If the Supreme Court has an explicit delegation of laws, norms set in the form of administrative rules such as directives are recognized as legal orders, and the Supreme Court's judicial attitude, which has denied the principle of delegation of legislative power and explicit authorization, is more reasonable from a legal system perspective. Although it is a norm enacted in accordance with the constitutional and legal authorization procedures and has the nature of a legal order, the Supreme Court's interpretation has led to unfair consequences of being excluded from the current national legal system, which is also confusing in terms of establishing or understanding the national legal system. Accordingly, we urge the Supreme Court to carry out changes to related precedents as soon as possible, which are contradictory and illogical.
