이 글은 2019년 4월 헌법재판소에서 선고한 낙태죄 헌법불합치 결정 이후 대안 입법과 정책이 제대로 마련되지 않은 2023년 6월이라는 현재 시점에서 헌법재판소의 해당 결정을 돌아본다. 헌재의 결정은 형법상 낙태죄가 헌법에 합치하지 않으므로 개정해야 한다는 취지를 훨씬 넘어서서 국민들의 재생산권리를 보장하기 위한 보편적 정책의 마련의 계기가 되어야 한다. 이를 위해서 이 글은 국가 주도의 저출산 고령화 극복 정책을 모든 국민들의 재생산 정책으로 패러다임을 전환할 것을 제안한다. 논문에서는 재생산권리를 여성인권의 근간이라고 이해하고 2016년 유엔사회권위원회의 일반논평 22호 등을 통해 ‘성과 재생산 건강과 권리(SRHR)에 대해 살펴본다.
이 글은 경험조사연구의 중요성을 관련 자료의 생산, 상담과 교육과의 연관성 속에서 주목하면서 계류 중인 모자보건법안 중 정부안과 권인숙 의원안을 비교 분석하였다. 먼저, 정부안에서는 성과 재생산 건강과 권리라는 국제규범이 잘 반영되어 있지 않고 ‘생식건강’을 중심으로 모자보건사업을 정의하고 있어 문제적이다. 특히, 인공임신중절을 여성 건강의 측면에서 적극적으로 지원할 대상으로 삼는지 불분명한 개정안의 이중적인 태도를 발견할 수 있다. 둘째, 정부안에서 실태조사의 범위를 임신중지에 국한하고 있어서 국민들의 재생산활동에 관한 조사연구로는 너무 협소하다. 반면 권인숙 의원안에서는 임신 출산을 포함한 재생산활동과 건강문제로 영역을 넓히고 있다. 셋째, 기존의 인공임신중절 조사에서는 주로 온라인 설문조사를 방법을 사용하였는데 이제는 그동안 말할 수 없었던 여성의 ‘목소리’를 듣는 인터뷰 조사 등 질적 조사를 추진할 것으로 제안하였다. 넷째, 정부안에서 상담이란 정부의 형법개정안에서 규정하는 중반기 임신중절을 위한 ‘조건부 상담’의 역할을 하고 있는 바, 이런 의미의 상담이란 헌법재판소의 결정 취지와 관련 국제규범에 부합하지 않는다. 진정한 의미의 상담을 내실화하기 위해서는 비지시적인 상담, 보편적인 상담, 그리고 임산부의 필요성에 입각한 경청의 상담이 되어야 한다.
이 글은 재생산정책 수립을 위한 ‘지식’이란 국제적인 규범과 가치에서 올 뿐만 아니라 한국이라는 지금 이곳의 역사적이고 사회적인 현실에서 살아 숨쉬고 있다고 보고 있다. 그동안 낙태죄에 가려서 보이지 않았던 성관계, 임신, 임신중지, 출산 등에 관한 입법과 정책은 새롭게 마련되어야 할 어떤 것이지, ‘있는’ 지식을 시민들에게 제공하면 될 일은 아니다. 이 글에서 강조한 경험조사연구란 이 땅의 현실에 관한 지식의 생산과정이고, 이 지식이야말로 앞으로 수립될 인구 재생산 정책의 가장 믿을만한 기초가 될 것이다. 정부와 공공기관은 연구, 교육, 인권 기관 등이 수행하는 다양한 재생산 활동 및 조치 등에 관한 실태조사를 지원해야 한다.
This article reviews the Constitutional Court Decision about the crime of abortion in the Criminal Code in Korea(Art. 269, Para 1; Art, 270, Para 1). On April 11, 2019, the Court held the Articles incompatible with Constitution in Korea and the Articles should be revised no later than December 31, 2020. This study stands on the present time and space as of June 2023 where neither the following laws nor the integrated policy was legislated.
I interpret the significance of this decision not just in terms of abolition/revision of the above articles, but in terms of creating a systematic policy for the protection of reproductive rights in Korea. In this regard, the article pays attention to comparing the difference between the “low-fertility policy” and “reproductive rights policy” and suggests the paradigm needs to be shifted from the former to the latter. To have a basic understanding, of the concept of reproductive rights through the general comment No.22 on the right to sexual and reproductive health offered by the UN Economic and Social Council in 2016.
This article focuses on the importance of empirical research about people's reproductive activities, needs, conflicts, etc. in terms of data production, counseling, and education. From this aspect, it examines the bills of the Maternity of Protection Act. First, the governmental bill does not accommodate the international norms regarding reproductive rights as reflected in the notion of “procreation” as the bill’s center. Most of all, it is a critical issue that the government bill seems to hold an ambivalent stance on abortion even after the Constitutional decision. Secondly, the scope of empirical research is limited to abortion in the governmental bill. The study criticizes that it is too narrow to examine the reality of the reproductive activities of people. Whereas the scope was expanded to pregnancy and childbirth as well as abortion in the Representative Kwon Insook bill. Thirdly, the method of empirical research employed in the research conducted so far was mostly that of the online questionnaire. Since the experiences of sexual relations, pregnancy, abortion, and childbirth are mostly the areas untold or unknown, this study strongly suggests employing qualitative methods such as interviews. It will amount to listening to the women’s “voice.” Fourthly, the counseling in the governmental bill has tow-folded meanings; since the counseling is necessary for obtaining “permission” to abortion for second-trimester abortion in the governmental bill criminal code. This kind of counseling is compatible neither with Constitutional Court’s decision nor the international legal norms such as general comment No.22 by the UN Economic and Social Council. To be genuine counseling, it must be non-directive, universal, and responsive to each individual’s needs.
This study views the sources of knowledge for establishing the policy of reproduction in Korea are not only from the international norms and guidelines but also from the social reality here and now. Since the spheres of life such as sexual relations, pregnancy, abortion, and childbirth have been curtained by the crime of abortion, the knowledge about these activities is very much demanded. Although medical and legal knowledge about reproductive issues has been relatively well systematized, social and cultural and people’s mundane practices are not at all the area well collected and interpreted. Thus, active empirical researches about women’s reproductive experiences need to be conducted. The public fund can initiate such research at various levels and means.
