2019년 4월 헌법재판소는 낙태에 대한 형사처벌이 여성의 자기결정권을 과도하게 침해한 것으로 헌법불합치 결정을 내리며, 2020년 12월 말까지 개선입법을 촉구하였다. 그러나 2023년 5월까지 낙태죄의 개선입법은 이루어지지 않은 입법공백상태가 유지되고 있다. 헌법재판소의 개선입법시한을 경과하여 낙태죄가 무효화되었으니, 임신중단행위는 조건없이 전면 비범죄화된 상태로 해석되기도 한다. 그러나 헌법재판소의 낙태죄 헌법불합치 결정은 낙태죄의 전면 합법화를 의도한 것이 아닌, 모자보건법에 규정된 위법성 조각사유에 해당하지 않는 한 착상 이후 모든 임신중절행위를 범죄화하고 있던 규정에 대하여, 태아의 생명보호와 함께 여성의 자기결정권을 조화시킬 방안을 입법부에 위임한 것이다. 이와 관련하여 발의된 수많은 법안들에 대하여 여전히 다양한 비판들이 제기되며 아직 국회의 문턱을 넘지 못하고 있다. 프로 라이프와 프로 초이스의 대립은 토론과정을 거친다고 하더라도 절대적 가치에 대한 대립으로 말미암아 완벽한 의사의 합치는 어려울 것이라 판단된다. 그러나 낙태죄의 입법공백상태는 합법과 불법 사이의 모호한 경계에서 태아의 생명도, 안전하게 임신을 중단할 수 있는 권리도 보장되지 않으므로 더 이상 입법을 미뤄서는 안 된다.
결국 낙태죄의 개선입법방안은 결국 임신을 중단하는 행위가 범죄인가라는 질문에 대답하는 문제이다. 태아는 모체에 의존적으로 존재하지만, 또 다른 생명이자 별개의 인격체로 성장하기 때문에, 신체의 일부 기관과는 엄연히 다르다. 그렇다고 태아에 임신한 여성과 동등한 인격 및 권리성을 부여하여 임부의 자기결정권의 일방적 희생을 강요할 수 없다. 생명의 연속성으로 말미암아 발달과정에 따라 국가 역시 보호의 정도와 수단을 달리할 수 있다. 그러므로 보호할 이익이 커진 독자적 생존이 가능한 시기의 태아에 대한 보호는 국가의 의무이자 과제이다. 범죄는 타인의 법익을 침해하여 제재할 필요성이 있는 행위의 규제라고 정의할 때, 독자적 생존가능성을 기준으로, 독자적 생존가능성이 부정되는 태아 상태의 생명에 대한 침해는 범죄로 구성하지 아니하고, 독자적 생존가능성이 있는 생명에 대한 법익 침해는 예외적 사유가 없는 한, 형사처벌이 필요한 범죄로 구성하는 것이 타당하다는 결론이다.
In April 2019, the Constitutional Court of Korea ruled that criminalizing abortion excessively infringed upon women's right to self-determination and declared it unconstitutional. The court urged the legislature to enact legislation to address this issue by the end of December 2020. However, as of May 2023, no legislative improvements regarding abortion have been made, resulting in a legislative vacuum. The clash between pro-life and pro-choice positions, even through the process of debate, is deemed difficult to reconcile due to the conflict of absolute values.
However, in order to protect the life of the fetus or ensure safe termination of pregnancy, a law must be created that provides clear guidelines. Ultimately, the issue of improving abortion legislation boils down to the question of whether the act of terminating pregnancy should be considered a crime. Although the fetus exists dependently on the mother's body, it is also a separate entity and another life, with distinct individuality. However, granting the fetus equal personality and rights as the pregnant woman would impose an unjust sacrifice of the pregnant woman's right to self-determination. Considering the continuum of life and the ability to develop, the state can vary the degree and means of protection. Thus, protecting the life of a fetus at a stage where it has the potential for independent survival becomes both an obligation and a task for the state. Consequently, when defining a crime as the regulation of acts that require sanctions for infringing upon the legal interests of others, it is reasonable to consider the infringement upon the life of a fetus lacking the potential for independent survival as not constituting a crime. On the other hand, infringing upon the legal interests of a life with the potential for independent survival should be deemed a crime that necessitates criminal punishment unless there are exceptional reasons.
