민법 제256조에서 규정하는 부동산에의 부합에 관하여 종래 대법원은 대체로, 부착된 물건을 훼손하거나 과다한 비용을 지출하지 않고서는 부동산으로부터 분리할 수 없을 정도로 부착·합체되었는지 여부 및 그 물리적 구조, 용도와 기능 면에서 기존 부동산과는 독립한 경제적 효용을 가지고 거래상 별개의 소유권의 객체가 될 수 있는지 여부의 두 가지 기준을 제시하여 왔다.
그러나 이러한 종래의 기준만으로는 이해하기 쉽지 않은 사례들이 실무상 종종 나타나고 있다. 특히 물건이 부합된 부동산의 소유자 측에서 방해배제청구권의 행사로써 그 제거를 구하고 이에 대하여 부합을 주장하며 제거할 의무가 없다고 다투는 사안이 그러한바, 대상판결도 그러한 유형의 분쟁에 속한다. 이에 본고는 부동산에의 부합이 문제 되는 다양한 사례들을 포괄할 수 있는 설명을 제시하는 것을 목적으로 한다.
본고에서는 부합물의 소유권이 서로 자기에게 있다고 주장하는 전형적인 부합의 사안을 이른바 ‘양(+)의 부합’으로 분류하고, 이와 달리 부합물의 철거를 구하는 사안을 부합이 피부합물의 소유자에게 도움을 주지 못한다는 의미에서 ‘음(-)의 부합’으로 분류하였다. 그리고 부합제도가 공용수용과 유사하게 당사자 일방의 소유권 행사를 제한하는 측면이 있음에 착안하여, 어떠한 경우에 부합의 효과를 인정하는 것이 필요한지를 거래비용의 절감 및 이익형량의 관점에서 분석하였다. 그 결과 판례는 ‘양의 부합’과 ‘음의 부합’을 막론하고 두 물건이 부합된 상태와 분리된 상태를 비교하여 당사자들의 효용의 합이 전자의 경우에 더 크다면 부합을 인정하고 있다는 설명이 가능하다.
이러한 이익형량의 기준은 결국 분리로 인한 손실이 클수록 부합이 인정될 가능성이 높다는 점에서, 물리적 결합의 정도를 기준으로 하는 종래 대법원이 제시한 법리와도 어느 정도 일치하나, ‘음의 부합’의 사안을 만족스럽게 해결하기 어려운 기존 법리와 달리 ‘양의 부합’과 ‘음의 부합’ 모두에 대하여 일관된 설명이 가능하다는 장점이 있다. 이와 같이 본고는 부동산에의 부합을 판단하는 기준에 관하여 새로운 시각을 제시하고자 하였다.
Article 256 of the Korean Civil Act stipulates that the movables (chattel) attached to immovables (namely, pieces of land or buildings) also belong to the owners of the immovables. The Supreme Court of Korea has conventionally proposed two criteria concerning the attachment to immovables: whether the attached things can be separated from the immovables without being seriously damaged or incurring excessive costs; and whether they have distinct economic value and thus can be treated as objects of transaction independently.
In practice, however, cases where these conventional criteria cannot give satisfactory explanation, are easily to be found. It is especially so when the owner of the immovables demands the removal of the attached movables, while the (original) owner of the latter claims that he/she is neither obliged nor entitled to take away the movables of which he/she has already lost his/her right of ownership due to attachment. This article aims at offering a more comprehensive explanation applicable to various cases concerning such attachment.
This article classified various cases of attachment into two groups: the first group is the positive attachment, which comprises typical cases of attachment in which both parties claim the ownership of the attached movables; and the second group is the negative attachment, which does not enhance the value of the immovables on which the attachment happens, and therefore their owner demands the removal of the attached movables. Furthermore, by considering that the attachment system, similar to expropriation, restricts the ownership of the attached movables, this article tries to propose a new criterion for attachment based on the reduction of transaction cost and balancing of conflicting interests of the relevant parties.
As a result, this article explains that the Supreme Court of Korea compares the state of attachment with the state of separation, in which the movables at issue have been removed from the immovables, and decides that the attachment happens if the total utility of the parties concerned is greater under the former state. This is the case for both positive and negative attachment.
This new criterion of “balancing conflicting interests” means that the greater loss of utility is incurred from the separation, the more likely the attachment is to be recognized and, to some degree, corresponds to the conventional criteria based on the damage of attached movables or the costs of separation. However, it does not always lead to the same conclusion. The new criterion offers consistent explanation for both positive and negative attachment, while the conventional one often leads to an unsatisfactory result in case of negative attachment. This article, thus, offers a new perspective in relation to the criterion for attachment to the immovables.
