스마트폰 등 새로운 정보저장매체와 이와 결합된 메신저, 클라우드 등 인터넷서비스의 발전에 따라 개인의 일상생활과 여러 활동에 관한 총체적인 정보가 스마트폰 등 정보저장매체와 인터넷서비스 계정 안에 담겨지게 되었다. 이에 대한 압수·수색이 이루어지는 과정에서 그 적법성과 적정성을 담보하고 집행을 받는 당사자를 보호하기 위한 절차 참여권의 중요성이 매우 커지게 되었고, 최근 대법원은 전자정보 압수·수색의 참여권 법리에 관하여 몇 가지 의미 있는 판결들을 선고하였다.
먼저 대법원은 형사소송법 제219조, 제121조에 따라 수사절차의 압수·수색에서 참여권을 보장받는 당사자에 관하여 원칙적으로 ‘피압수·수색 당사자’(이하 ‘피압수자’라 한다)에 해당하여야 한다는 종전의 입장을 재확인하였다. 즉 참여권을 보장받는 피의자를 ‘전체 피의자’로 보지 않고 ‘피압수자인 피의자’로 보면서, 나아가 ‘피의자 아닌 피압수자’에 대해서도 위 규정을 준용하여 이를 근거로 참여권을 보장하는 입장을 보이고 있다. 이러한 대법원 판례의 입장을 비판하며 문언해석상 원칙적으로 수사절차의 압수·수색에서 참여권자는 ‘전체 피의자’로 보는 것이 타당하다는 견해들이 제기되고 있다. 그러나 압수·수색처분으로 인한 기본권 침해의 직접적 당사자가 누구인지, 공판절차와 수사절차의 차이점을 고려한 형사소송법상 준용 규정에 대한 합리적 해석의 필요성, 전체 피의자를 참여권 보장의 대상으로 볼 경우 실무상 예상되는 여러 난점, 형사소송법 관련 규정의 체계적 해석 등을 종합해 보면, 형사소송법 제121조를 피압수자에 대한 참여권 보장의 기본적 근거조항으로 삼아 피압수자의 절차적 권리를 보장하는 해석이 불가피하다고 생각된다.
다음으로 대법원은 전자정보 압수·수색에 있어서 ‘실질적 피압수자’ 개념을 도입하여 참여권을 보장받는 당사자의 범위를 일부 확장하였다. 휴대성이 용이한 스마트폰 등이 원래 사용자의 지배·관리를 벗어나 제3자의 보관하에 있다가 압수·수색의 대상이 되는 경우, 또는 인터넷서비스 이용자가 생성·저장·이용한 사적인 전자정보가 물리적으로는 사업자의 서버 내에 있다는 이유로 사업자를 상대로 압수·수색이 이루어지는 경우에, 종래의 형식적 피압수자 개념에 따르면 타인의 정보저장매체를 보관하고 있는 제3자 또는 인터넷서비스 사업자가 ‘피압수자’에 해당하여 참여권을 인정받을 뿐이었다. 대법원은 이러한 매체 사용자 개인의 총체적·전인격적 정보가 압수·수색의 대상이 되었음에도 참여권을 인정받지 못하는 불합리한 상황을 받아들이기 어렵다고 보아, 압수·수색과 근접한 시기까지 해당 스마트폰 등 정보저장매체나 인터넷서비스 계정을 자신의 것으로 사용해 온 사람을 ‘실질적 피압수자’로 평가하여 참여권을 보장하여야 한다는 법리를 제시하게 되었다.
이러한 대법원의 실질적 피압수자 법리는 스마트폰 등 물리적 정보저장매체, 가상공간의 인터넷서비스 계정 등 전자정보 전반이 담겨진 해당 ‘매체’를 기준으로 삼아 그 매체의 현실적 지배·관리·이용자에게 실질적 피압수자성을 인정하는 취지이다. 또한 이와 같은 매체에 대한 현실적 지배·관리·이용 상태는 그 내부 전자정보에 대한 전속적인 관리처분권을 전제로 한 것이어야 한다. 본 논문은 대법원 판례가 제시한 실질적 피압수자 법리의 구체적인 요건에 대하여 상세하게 설명하고, 2023. 6. 2. 대법원 형사법연구회·한국형사법학회 공동학술대회에서 수사기관 측이 질의한 다양한 사례들에 대한 필자의 검토의견을 제시함으로써 위 법리의 의미와 취지를 보다 분명하게 알리고자 한다. 나아가 수사기관의 입장에서 위 법리에 비판적인 견해와 자기정보결정권 침해를 기준으로 오히려 이보다 폭넓게 참여권을 인정하는 견해를 모두 살펴보고, 대법원 판례의 실질적 피압수자 법리는 적정하고 실현 가능한 범위에서 당사자의 절차적 권리를 보장하고 기본권에 대한 침해를 최소화하기 위한 방안으로 고안된 것임을 논증하고자 한다.
The development of new information storage media such as smartphones and internet services combined with them such as messengers, clouds, etc. has led to the accumulation of the overall information on individuals’ daily lives and various activities in above information storage media and internet service accounts. As a result, the importance of procedural participation right to ensure the legality and appropriateness of search and seizure and to protect the parties subject to the execution has increased very much, and the Supreme Court has recently rendered several significant judgments on the legal doctrine regarding the right to participate in search and seizure of electronic information.
First, the Supreme Court reaffirmed its previous position that the party to whom the right to participate is guaranteed in search and seizure of the investigation procedure under Articles 121 and 219 of the Criminal Procedure Act should, in principle, be the person who is subject to search and seizure. In other words, the Supreme Court holds that the persons who are guaranteed to participate in search and seizure of the investigation procedure should be the “suspects who are searched and seized,” not “all suspects,” and that the right to participate should be also granted to “the persons who are not suspected but searched and seized” by applying above provisons. Some views have criticized the Supreme Court’s position and argued that, in principle, the persons who have the right to participate in search and seizure of the investigation procedure should be “all suspects” in terms of literal interpretation. However, if we consider the following factors, it is inevitable that the procedural right of the person subject to search and seizure should be guaranteed by interpreting Article 121 of the Criminal Procedure Act as the basic regulation for guaranteeing the right to participate in the procedure of the person subject to search and seizure: who is the direct victim of fundamental rights infringement due to search and seizure order; the need for a reasonable interpretation of the Criminal Procedure Act’s application provisions taking into account the differences between the public trial procedure and the investigation procedure; the many practical problems expected if all suspects are considered to be those who are guaranteed to participate in search and seizure of the investigation procedure; and the systematic interpretation of the relevant provisions of the Criminal Procedure Act.
Second, the Supreme Court introduced the concept of “actual person subject to search and seizure” in search and seizure of electronic information and partially expanded the scope of parties who are granted the right to participate. Where a portable smartphone, which is out of the original user’s control and management and kept by a third party, becomes subject to search and seizure, or where a service provider becomes subject to search and seizure on the grounds that private electronic information generated, stored, and used by an internet service user is physically located on the service provider’s server, the traditional formal concept about a person subject to search and seizure recognized a third party who stores the information storage medium of another person or an internet service provider as “a person subject to search and seizure” and thus merely granted the right to participate to him/her. The Supreme Court, by viewing that accepting the unreasonable situation where even though the individual’s overall and personal information becomes subject to search and seizure, the individual is not granted the right to participate is difficult, has presented a legal doctrine that a person who have used an information storage medium such as a smartphone or an internet service account as his or her own until the near time of search and seizure should be evaluated as an “actual person subject to search and seizure” and thus the right to participate should be granted to such person.
The Supreme Court’s “actual person subject to search and seizure” doctrine is to recognize the actual controller, manager, and user of the relevant “medium” which contains comprehensive electronic information including a physical information storage medium such as a smartphone and an internet service account in the virtual space as the real victim of search and seizure. The actual control, management, and usage status of such medium should be based on the exclusive right to manage and dispose of the internal electronic information. This paper will explain in detail the specific requirements of “actual person subject to search and seizure” doctrine presented in the Supreme Court’s precedents, and will make the meaning and purpose of the doctrine clearer by presenting the author’s opinion on various cases raised by investigative agencies at the joint academic conference of the Supreme Court Criminal Law Research Institute and the Korean Criminal Law Association on June 2, 2023. In addition, this paper will examine the critical view about the doctrine from the standpoint of investigative agencies and the view that even more broadly recognizes the right to participate in search and seizure based on the infringement of the right to informational self-determination, and will demonstrate that the Supreme Court’s “actual person subject to search and seizure” doctrine is a way to guarantee the procedural rights of the parties to be executed and to minimize the violation of fundamental human rights within a reasonable and feasible scope.
